AN ACT
To direct the Secretary of the Interior to conduct a study
to assess the suitability and feasibility of designating
areas within the island of Guam as a National Heritage
Area, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. THE GUAM NATIONAL HERITAGE AREA STUDY.

(a) STUDY.—
2
(1) IN GENERAL.—The Secretary, in consulta-
3
tion with appropriate regional and local organiza-
4
tions or agencies, shall conduct a study to assess the
5
suitability and feasibility of designating the study
6
areas as National Heritage Areas.
7
(2) REQUIREMENTS.—The study shall include
8
analysis, documentation, and determinations on
9
whether the study areas—
10
(A) has an assemblage of natural, historic,
11
and cultural resources that—
12
(i) represent distinctive aspects of the
13
heritage of the United States;
14
(ii) are worthy of recognition, con-
15
servation, interpretation, and continuing
16
use by residents and visitors; and
17
(iii) would be best managed—
18
(I) through partnerships among
19
public and private entities; and
20
(II) by linking diverse and some-
21
times noncontiguous resources and ac-
22
tive communities that share a com-
23
mon heritage;

(B) reflects traditions, customs, beliefs,
1
and folklife that are a valuable part of the story
2
of the United States;
3
(C) provides—
4
(i) outstanding opportunities to con-
5
serve natural, historic, cultural, or scenic
6
features; and
7
(ii) outstanding recreational and edu-
8
cational and cultural tourism opportuni-
9
ties;
10
(D) contains resources that—
11
(i) are important to any identified
12
themes of the study area; and
13
(ii) retain a degree of integrity capa-
14
ble of supporting interpretation;
15
(E) includes residents, business interests,
16
nonprofit organizations, including museums and
17
heritage organizations, and State and local gov-
18
ernments that—
19
(i) are involved in the planning of the
20
National Heritage Area;
21
(ii) have developed a conceptual finan-
22
cial plan that outlines the roles of all par-
23
ticipants in the Area, including the Federal
24
Government; and

(iii) have demonstrated support for

the designation of the Area;
2
(F) has a potential management entity to
3
work in partnership with the individuals and
4
entities described in subparagraph (E) to de-
5
velop the Area while encouraging State and
6
local economic activity; and
7
(G) has a conceptual boundary map that is
8
supported by the public.

(b) PRIVATE PROPERTY CONSIDERATIONS.—In con-
10
ducting the study, the Secretary shall consider the poten-
11
tial impact that designation of the study area as a national
12
heritage area would have on private property on Guam.
13
(c) REPORT.—Not later than the end of the third fis-
14
cal year after the date on which funds are first made avail-
15
able for this section, the Secretary shall submit to the
16
Committee on Natural Resources of the House of Rep-
17
resentatives and the Committee on Energy and Natural
18
Resources of the Senate a report that describes—
19
(1) the findings of the study; and
20
(2) any conclusions and recommendations of the
21
Secretary.

(d) DEFINITIONS.—In this section:
23
(1) AREA.—The term ‘‘Area’’ means a National
24
Heritage Area located in Guam.

(2) SECRETARY.—The term ‘‘Secretary’’ means

the Secretary of the Interior.

(3) STUDY
AREA.—The term ‘‘study area’’

means the island of Guam.
