To require United States educational institutions to include information re-
garding financial transactions with the Government of the People’s Re-
public of China or its affiliates in any petition for certification or recer-
tification with the Student and Exchange Visitor Program.

the following bill; which was read twice and referred to the Committee
on the Judiciary
A BILL
To require United States educational institutions to include
information regarding financial transactions with the
Government of the People’s Republic of China or its
affiliates in any petition for certification or recertification
with the Student and Exchange Visitor Program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SUPPORTING DOCUMENTS REQUIRED FOR

CERTIFICATION WITH THE STUDENT AND EX-
2
CHANGE VISITOR PROGRAM.

Section 641(d) of the Illegal Immigration Reform and
4
Immigrant Responsibility Act of 1996 (8 U.S.C. 1372(d))
5
is amended—
6
(1) in paragraph (1)(A), by striking ‘‘institu-
7
tion,,’’ and inserting ‘‘institution,’’;
8
(2) by redesignating paragraph (2) as para-
9
graph (3);
10
(3) by inserting after paragraph (1) the fol-
11
lowing:
12
‘‘(2) SUPPORTING DOCUMENTS REQUIRED FOR
13
CERTIFICATION.—Institutions of higher education
14
and other approved educational institutions peti-
15
tioning for certification or recertification with the
16
Student and Exchange Visitor Program to authorize
17
the attendance of nonimmigrant students described
18
in subparagraph (F)(i) or (M)(i) of section
19
101(a)(15) of the Immigration and Nationality Act
20
(8 U.S.C. 1101(a)(15)) shall include with such peti-
21
tion—
22
‘‘(A) final copies of any contracts, agree-
23
ments, or documentation of financial trans-
24
actions between the institution or its affiliated
25
student or faculty groups, foundations, or re-

lated entities and any educational, cultural, or

language entity that is directly or indirectly
2
funded by the Government of the People’s Re-
3
public of China; and
4
‘‘(B) a detailed description of any financial
5
contributions from the Government of the Peo-
6
ple’s Republic of China or its affiliates to any
7
student or faculty groups affiliated with such
8
institution.’’; and
9
(4) in paragraph (3), as redesignated—
10
(A) by striking ‘‘specified information,
11
such approvals’’ and inserting the following:
12
‘‘information and documentation described in
13
paragraphs (1) and (2)—
14
‘‘(A) such approvals’’; and
15
(B) by striking the period at the end and
16
inserting the following: ‘‘; and
17
‘‘(B) if such failure involves the informa-
18
tion or documentation described in paragraph
19
(2), the Student and Exchange Visitor Program
20
shall conduct an out-of-cycle review of the insti-
21
tution.’’.
