A BILL
To amend the Small Business Act to ensure duplicate loans
are ineligible under the paycheck protection program,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘No Duplicate PPP
4
Loans Act of 2021’’.
5
SEC. 2. INELIGIBLE DUPLICATE LOANS UNDER THE PAY-
6
CHECK PROTECTION PROGRAM.

(a) IN GENERAL.—Section 7A of the Small Business
8
Act (15 U.S.C. 636m) is amended by adding to the end
9
the following new subsection:

‘‘(m) INELIGIBLE DUPLICATE LOANS.—Any bor-
1
rower that knowingly and willfully submits false informa-
2
tion for the purposes of obtaining a covered loan under
3
section 7(a)(36) shall be required to repay any amount
4
of such covered loan.’’.

(b) GUIDANCE.—Not later than 10 days after the
6
date of the enactment of this Act, the Administrator of
7
the Small Business Administration shall issue guidance to
8
carry out the amendments made by this Act.

SEC. 3. REPORT ON INELIGIBLE DUPLICATE LOANS.

(a) REPORT TO CONGRESS.—Not later than 1 week
11
after the date of the enactment of this Act, and weekly
12
thereafter until the last day of the covered period (as de-
13
fined in section 7(a)(36)(A) of the Small Business Act (15
14
U.S.C. 636(a)(36)(A)), the Administrator of the Small
15
Business Administration shall submit to the Committees
16
on Banking, Housing, and Urban Affairs and Small Busi-
17
ness and Entrepreneurship of the Senate, and the Com-
18
mittees on Financial Services and Small Business of the
19
House of Representatives, a report on ineligible duplicate
20
loans (as described under section 7A(m) of the Small
21
Business Act, as added by this Act) that includes—
22
(1) the number of attempted applications for
23
such ineligible duplicate loans;

(2) the number of processed applications for
1
such ineligible duplicate loans;
2
(3) dollars disbursed for such ineligible dupli-
3
cate loans; and
4
(4) actions taken by the Administrator to—
5
(A) review potential disbursements for
6
such ineligible duplicate loans;
7
(B) recover improper disbursements for
8
such ineligible duplicate loans;
9
(C) strengthen technical systems to ensure
10
the detection of such ineligible duplicate loan
11
applications; and
12
(D) provide guidance to lenders on such
13
ineligible duplicate loan applications.

(b) PUBLICATION.—Not later than 7 days after the
15
date on which the Administrator submits a report required
16
under subsection (a), the Administrator shall publish such
17
report on a website of the Small Business Administration.
