A BILL
To allow amounts made available under the American Rescue
Plan Act of 2021 for the Coronavirus State Fiscal Recov-
ery Fund and the Coronavirus Local Fiscal Recovery
Fund to be made available to eligible law enforcement
agencies for border security, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘American Border Res-
4
cue Plan Act’’.

SEC. 2. CORONAVIRUS RELIEF FUNDS FOR BORDER SECU-

RITY.

(a) IN GENERAL.—Amounts made available by the
3
American Rescue Plan Act of 2021 (Public Law 117–2)
4
for the Coronavirus State Fiscal Recovery Fund and the
5
Coronavirus Local Fiscal Recovery Fund may also be
6
made available to eligible law enforcement agencies for the
7
purposes described in subsection (b).

(b) PURPOSES.—The purposes in this subsection are
9
the following:
10
(1) Equipment, including maintenance and
11
sustainment costs for enhanced border law enforce-
12
ment activities.
13
(2) Personnel, including overtime and backfill
14
for law enforcement personnel or non-law enforce-
15
ment personnel who support enhanced border law
16
enforcement activities.
17
(3) Allowable and approved personnel costs, in-
18
cluding salaries, fringe benefits, overtime and back-
19
fill for dedicated intelligence analysts supporting Op-
20
eration Stonegarden operations in support of en-
21
hanced border law enforcement activities.

(4) Any activity permitted for Operation

Stonegarden under—

(A) the Department of Homeland Secu-

rity’s most recent Homeland Security Grant
2
Program Notice of Funding Opportunity; or
3
(B) the Federal Emergency Management
4
Agency’s Preparedness Grants Manual.
5
(5) Any other appropriate activity, as deter-
6
mined by the Secretary.

(c) ELIGIBLE LAW ENFORCEMENT AGENCIES DE-
8
FINED.—The term ‘‘eligible law enforcement agencies’’
9
means a law enforcement agency that is—
10
(1) located in—
11
(A) a State bordering Canada or Mexico;
12
or
13
(B) a State or territory with an inter-
14
national maritime border; and
15
(2) is involved in an active, ongoing, U.S. Cus-
16
toms and Border Protection operation coordinated
17
through a sector office.
