SHORT TITLE. 4 This Act may be cited as the ‘‘Green New Deals for 5 Cities Act of 2021’’. 6 SEC. 102. GREEN NEW DEAL FOR CITIES, TOWNS, AND NA- 7 TIVE AMERICAN NATIONS. 8 (a) IN GENERAL.—From amounts appropriated to 9 carry out this title, the Secretary of Housing and Urban 10 Development, in coordination with the Secretary of En- 11 ergy, the Secretary of Labor, and the Office of Domestic 12 Climate Policy, shall be allocated directly to eligible local 13 or State entities in the same manner as amounts appro- 14 priated under sections 602 and 603 of title VI of the So- 15 cial Security Act (42 U.S.C. 801 et seq.), as applicable, 16 to carry out eligible Green New Deal projects. 17 (b) USE OF FUNDS.—An eligible local or State entity 18 receiving an allocation under this section— 19 (1) may use such funds to carry out an eligible 20 Green New Deal project; and 4 (4) may not use such funds for— 5 (A) fossil fuel procurement, development, 6 infrastructure repair that would in anyway ex- 7 tend lifespan or production capacity, or any re- 8 lated subsidy; 9 (B) carbon capture and storage (CCS) or 10 carbon capture, utilisation, and storage 11 (CCUS); 12 (C) direct air capture; 13 (D) the procurement of nuclear power; 14 (E) research and development; 15 (F) the establishment or advancement of 16 carbon markets, including cap and trade; 17 (G) geoengineering; 18 (H) highway expansion; 19 (I) road improvements or automobile infra- 20 structure, other than electric vehicle charging 21 stations; 22 (J) industrial scale bioenergy, including 23 biofuels, biomass, and biogas, development or 24 any related subsidy; or 25 VerDate Sep 11 2014 03:53 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2644.IH H2644 kjohnson on DSK79L0C42PROD with BILLS 7 •HR 2644 IH (K) any investments or projects supporting 1 law enforcement, immigration detention centers, 2 and prisons, including buildings and vehicles 3 under the control of law enforcement or a pris- 4 on. 5 (c) REQUIREMENT.—As a condition of accepting an 6 allocation provided under this section, an eligible local or 7 State entity shall agree to take steps, in consultation with 8 community groups and tenant advocates, to secure exist- 9 ing housing in neighborhoods receiving benefits from an 10 allocation under this section, including through the use of 11 rent control, rent stabilization, and other methods to pre- 12 vent gentrification and stabilize property values. 13 (d) CONSULTATION.—In carrying out the program 14 established under subsection (a), the Secretary shall con- 15 sult with Administration of the Environmental Protection 16 Agency, the Assistant Secretary of the Bureau of Indian 17 Affairs, and the Council on Environmental Quality. 18 (e) NATIVE AMERICAN FPIC.—Prior to the author- 19 ization of any project on land that may affect a Native 20 American Nation, the Secretary shall ensure that such 21 Nation has given FPIC. 22 (f) MATERIAL REQUIREMENT.—In carrying out any 23 eligible Green New Deal project that uses renewable en- 24 ergy materials, an eligible local or State entity shall use 25 VerDate Sep 11 2014 03:53 Jun 02, 2021 Jkt 019200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2644.IH H2644 kjohnson on DSK79L0C42PROD with BILLS 8 •HR 2644 IH only renewable energy materials from Initiative for Re- 1 sponsible Mining Assurance (IRMA) certified mines. 2 (g) COMMUNITY INVOLVEMENT.—In carrying out 3 any eligible Green New Deal project, an eligible local or 4 State entity shall develop a public participation plan to 5 establish steps for ensuring decision-making inclusion of 6 frontline communities for such eligible Green New Deal 7 project. 8 (h) DEFINITIONS.—In this section: 9 (1) ELIGIBLE LOCAL OR STATE ENTITY.—The 10 term ‘‘eligible local or State entity’’ means a State, 11 local government, or Native American Nation that 12 has a local Green New Deal program proposal. 13 (2) ELIGIBLE GREEN NEW DEAL PROJECT.— 14 The term ‘‘eligible Green New Deal project’’ includes 15 a project and associated labor— 16 (A) for solar power procurement, installa- 17 tion, maintenance, and operations; 18 (B) for wind power procurement, installa- 19 tion, maintenance, coating, and operations; 20 (C) to carry out an American Society of 21 Heating, Refrigerating, and Air Conditioning 22 Engineers (ASHRAE) level II audit for com- 23 mercial buildings; 4 (E) to provide grants for acquisition of pri- 5 vate lands by Native American Land Trusts, 6 nations, and Tribes; 7 (F) to build electrification for heating, hot 8 water, and cooking; 9 (G) for public electric vehicle procurement; 10 (H) to build capacity for communities to 11 endure extreme weather events, such as invest- 12 ments to cooling and heating centers and dis- 13 aster preparedness; 14 (I) for community farming initiatives that 15 promote and foster food sovereignty; 16 (J) to procure, install, and operate geo- 17 thermal power; 18 (K) for phasing out existing fossil fuel in- 19 frastructure; 20 (L) for testing of soils and waters in 21 parks, playgrounds, and other sites for haz- 22 ardous and radioactive wastes as well as dan- 23 gerous chemicals, including PFAS; 5 (N) to repair gas pipeline leaks and cover 6 orphan wells, so long as such pipelines and 7 wells in no way expand fossil fuel production; 8 (O) to build, expand, and maintain public 9 parks, trails, forests, and recreation sites; 10 (P) for installation of weatherization and 11 efficiency measures, including reflecting coat- 12 ings; 13 (Q) for adaptation measures; 14 (R) to procure and install electric vehicle 15 charging stations; 16 (S) to remediate lead paint, mold, and as- 17 bestos; 18 (T) to support reparations programs for 19 Black and Indigenous people and communities; 20 (U) for investment in new or improved 21 public green space, parks, playgrounds, or com- 22 munity gardens; 9 (AA) to procure, install, and maintain 10 clean drinking water infrastructure piping and 11 transmission lines, including replacing lead 12 pipelines; 13 (BB) for public utility procurement, mod- 14 ernization, and decarbonization; 15 (CC) for wetland, forest, and public land 16 revitalization and other climate adaptation 17 measures; 18 (DD) for public sanitation, broadband, and 19 utility expansion for frontline communities; 20 (EE) for community solar power; 2 (GG) for restoring public lands, water- 3 sheds, coastal areas, wildlife corridors, and 4 other critical ecosystems, including investment 5 in county and city parks and Tribal manage- 6 ment of public lands; 7 (HH) for temporary housing for low-in- 8 come families receiving housing improvements; 9 or 10 (II) for conservation projects on family 11 farms, including water conservation projects, 12 shelterbelts, and ecosystem restoration efforts. 13 SEC. 103. AUTHORIZATION OF APPROPRIATIONS. 14 For purposes of carrying out this title, there is au- 15 thorized to be appropriated out of the general fund of the 16 Treasury— 17 (1) $400,000,000,000 for fiscal year 2022; 18 (2) $300,000,000,000 for fiscal year 2023; 19 (3) $200,000,000,000 for fiscal year 2024; and 20 (4) $100,000,000,000 for fiscal year 2025. 21 TITLE II—LABOR STANDARDS 22 SEC. 201.
