SHORT TITLE. 1 This Act may be cited as the ‘‘Drug Cartel Terrorist 2 Designation Act’’. 3 SEC. 2. REPORT ON DESIGNATION OF CERTAIN DRUG CAR- 4 TELS AS FOREIGN TERRORIST ORGANIZA- 5 TIONS. 6 (a) SENSE OF CONGRESS.—It is the sense of Con- 7 gress that each of the drug cartels set forth in subsection 8 (b) meets the criteria for designation as a foreign terrorist 9 organization as set forth in section 219 of the Immigration 10 and Nationality Act (8 U.S.C. 1189). 11 (b) DESIGNATION.—The Secretary of State shall des- 12 ignate each of the following Mexican drug cartels as a for- 13 eign terrorist organization under such section 219: 14 (1) The Reynosa/Los Metros faction of the Gulf 15 Cartel. 16 (2) The Cartel Del Noreste faction of Los 17 Zetas. 18 (c) REPORT.— 19 (1) REPORT REQUIRED.—Not later than 30 20 days after the date of the enactment of this Act, the 21 Secretary of State, in consultation with the Director 22 of National Intelligence, shall submit to the appro- 23 priate committees of Congress— 24 (A) a detailed report on each of the drug 25 cartels listed in section (2)(b) and any other 26 VerDate Sep 11 2014 23:40 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2600.IH H2600 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2600 IH cartels the Secretary may identify, including the 1 criteria met for designation as a foreign ter- 2 rorist organization as set forth in section 219 3 of the Immigration and Nationality Act (8 4 U.S.C. 1189); and 5 (B) for each of the cartels designated 6 under subsection (b), if the Secretary deter- 7 mines that the drug cartel does not meet the 8 criteria set forth under such section 219, a de- 9 tailed justification as to which criteria have not 10 been met. 11 (2) DESIGNATION OF ADDITIONAL CARTELS.— 12 Not later than 30 days after the submission of the 13 report the Secretary shall designate any cartel or 14 any faction thereof as a foreign terrorist organiza- 15 tion listed in the report that met the criteria for des- 16 ignation as a foreign terrorist organization as set 17 forth in section 219 of the Immigration and Nation- 18 ality Act (8 U.S.C. 1189). 19 (3) FORM.—The report required by paragraph 20 (1) shall— 21 (A) be submitted in unclassified form, but 22 may include a classified annex; and 23 (B) be made available only in electronic 24 form and shall not be printed, except if a print- 25 VerDate Sep 11 2014 23:40 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2600.IH H2600 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2600 IH ed copy is requested by an office of the legisla- 1 tive branch. 2 (4) APPROPRIATE COMMITTEES OF CONGRESS 3 DEFINED.—In this subsection, the term ‘‘appro- 4 priate committees of Congress’’ means— 5 (A) the Committee on Armed Services, the 6 Committee on Financial Services, the Com- 7 mittee on Foreign Affairs, the Committee on 8 the Judiciary, the Committee on Homeland Se- 9 curity, and the Permanent Select Committee on 10 Intelligence of the House of Representatives; 11 and 12 (B) the Committee on Armed Services, the 13 Committee on Banking, Housing, and Urban 14 Affairs, the Committee on Foreign Relations, 15 the Committee on the Judiciary, the Committee 16 on Homeland Security and Governmental Af- 17 fairs, and the Select Committee on Intelligence 18 of the Senate. 19 Æ VerDate Sep 11 2014 23:40 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2600.IH H2600 kjohnson on DSK79L0C42PROD with BILLS
