SHORT TITLE. 3 This Act may be cited as the ‘‘SFC Heath Robinson 4 Burn Pit Transparency Act’’. 5 SEC. 2. NOTIFICATIONS AND REPORTS REGARDING RE- 6 PORTED CASES OF BURN PIT EXPOSURE. 7 (a) QUARTERLY NOTIFICATIONS.— 8 VerDate Sep 11 2014 23:41 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2601.IH H2601 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 2601 IH (1) IN GENERAL.—On a quarterly basis, the 1 Secretary of Veterans Affairs shall submit to the ap- 2 propriate congressional committees a report on each 3 reported case of burn pit exposure by a covered vet- 4 eran reported during the previous quarter. 5 (2) ELEMENTS.—Each report submitted under 6 paragraph (1) shall include, with respect to each re- 7 ported case of burn pit exposure of a covered vet- 8 eran included in the report, the following: 9 (A) Notice of the case, including the med- 10 ical facility at which the case was reported. 11 (B) Notice of, as available— 12 (i) the enrollment status of the cov- 13 ered veteran with respect to the patient en- 14 rollment system of the Department of Vet- 15 erans Affairs under section 1705(a) of title 16 38, United States Code; 17 (ii) a summary of all health care visits 18 by the covered veteran at the medical facil- 19 ity at which the case was reported that are 20 related to the case; 21 (iii) the demographics of the covered 22 veteran, including age, sex, and race; 3 (v) the Armed Force in which the cov- 4 ered veteran served and the rank of the 5 covered veteran; 6 (vi) the period in which the covered 7 veteran served; 8 (vii) each location of an open burn pit 9 from which the covered veteran was ex- 10 posed to toxic airborne chemicals and 11 fumes during such service; 12 (viii) the medical diagnoses of the cov- 13 ered veteran and the treatment provided to 14 the veteran; and 15 (ix) whether the covered veteran is 16 registered in the Airborne Hazards and 17 Open Burn Pit Registry. 18 (3) PROTECTION OF INFORMATION.—The Sec- 19 retary shall ensure that the reports submitted under 20 paragraph (1) do not include the identity of covered 21 veterans or contain other personally identifiable 22 data. 23 (b) ANNUAL REPORT ON CASES.— 24 VerDate Sep 11 2014 23:41 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2601.IH H2601 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2601 IH (1) IN GENERAL.—Not later than 180 days 1 after the date of the enactment of this Act, and an- 2 nually thereafter, the Secretary of Veterans Affairs, 3 in collaboration with the Secretary of Defense, shall 4 submit to the appropriate congressional committees 5 a report detailing the following: 6 (A) The total number of covered veterans. 7 (B) The total number of claims for dis- 8 ability compensation under chapter 11 of title 9 38, United States Code, approved and the total 10 number denied by the Secretary of Veterans Af- 11 fairs with respect to a covered veteran, and for 12 each such denial, the rationale of the denial. 13 (C) A comprehensive list of— 14 (i) the conditions for which covered 15 veterans seek treatment; and 16 (ii) the locations of the open burn pits 17 from which the covered veterans were ex- 18 posed to toxic airborne chemicals and 19 fumes. 20 (D) Identification of any illnesses relating 21 to exposure to open burn pits that formed the 22 basis for the Secretary to award benefits, in- 23 cluding entitlement to service connection or an 24 increase in disability rating. 25 VerDate Sep 11 2014 23:41 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2601.IH H2601 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 2601 IH (E) The total number of covered veterans 1 who died after seeking care for an illness relat- 2 ing to exposure to an open burn pit. 3 (F) Any updates or trends with respect to 4 the information described in subparagraphs (A), 5 (B), (C), (D), and (E) that the Secretary deter- 6 mines appropriate. 7 (2) MATTERS INCLUDED IN FIRST REPORT.— 8 The Secretary shall include in the first report under 9 paragraph (1) information specified in subsection 10 (a)(2) with respect to reported cases of burn pit ex- 11 posure made during the period beginning January 1, 12 1990, and ending on the day before the date of the 13 enactment of this Act. 14 (c) INCLUSION OF INFORMATION AFTER DEATH AND 15 PROVISION OF INFORMATION REGARDING OPEN BURN 16 PIT REGISTRY.—Section 201(a) of the Dignified Burial 17 and Other Veterans’ Benefits Improvement Act of 2012 18 (Public Law 112–260; 38 U.S.C. 527 note) is amended 19 by adding at the end the following new paragraphs: 20 ‘‘(3) REPORTING OF INFORMATION AFTER 21 DEATH.—The Secretary of Veterans Affairs shall 22 permit a survivor of a deceased veteran to report to 23 the registry under paragraph (1) the exposure of the 24 veteran to toxic airborne chemicals and fumes 25 VerDate Sep 11 2014 23:41 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2601.IH H2601 kjohnson on DSK79L0C42PROD with BILLS 6 •HR 2601 IH caused by an open burn pit, even if such veteran was 1 not included in the registry before their death. 2 ‘‘(4) INFORMATION REGARDING REGISTRY.— 3 ‘‘(A) NOTICE.—The Secretary of Veterans 4 Affairs shall ensure that a medical professional 5 of the Department of Veterans Affairs informs 6 a veteran of the registry under paragraph (1) 7 if the veteran presents at a medical facility of 8 the Department for treatment that the veteran 9 describes as being related to, or ancillary to, the 10 exposure of the veteran to toxic airborne chemi- 11 cals and fumes caused by open burn pits. 12 ‘‘(B) DISPLAY.—In making information 13 public regarding the number of participants in 14 the registry under paragraph (1), the Secretary 15 shall display such numbers by both State and 16 by congressional district.’’. 17 (d) COMPTROLLER GENERAL REPORT.—Not later 18 than 180 days after the date of the enactment of this Act, 19 the Comptroller General of the United States shall submit 20 to the appropriate congressional committees a report con- 21 taining an assessment of the effectiveness of any memo- 22 randum of understanding or memorandum of agreement 23 entered into by the Secretary of Veterans Affairs with re- 24 spect to— 25 VerDate Sep 11 2014 23:41 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00006 Fmt 6652 Sfmt 6201 E:\BILLS\H2601.IH H2601 kjohnson on DSK79L0C42PROD with BILLS 7 •HR 2601 IH (1) the processing of reported cases of burn pit 1 exposure; and 2 (2) the coordination of care and provision of 3 health care relating to such cases at medical facili- 4 ties of the Department of Veterans Affairs and at 5 non-Department facilities. 6 (e) DEFINITIONS.—In this section: 7 (1) The term ‘‘Airborne Hazards and Open 8 Burn Pit Registry’’ means the registry established 9 by the Secretary of Veterans Affairs under section 10 201 of the Dignified Burial and Other Veterans’ 11 Benefits Improvement Act of 2012 (Public Law 12 112–260; 38 U.S.C. 527 note). 13 (2) The term ‘‘appropriate congressional com- 14 mittees’’ means— 15 (A) the Committee on Veterans’ Affairs 16 and the Committee on Armed Services of the 17 Senate; and 18 (B) The Committee on Veterans’ Affairs 19 and the Committee on Armed Services of the 20 House of Representatives. 21 (3) The term ‘‘covered veteran’’ means a vet- 22 eran who presents at a medical facility of the De- 23 partment of Veterans Affairs (or in a non-Depart- 24 ment facility pursuant to section 1703 or 1703A of 25 VerDate Sep 11 2014 23:41 Jun 01, 2021 Jkt 019200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2601.IH H2601 kjohnson on DSK79L0C42PROD with BILLS 8 •HR 2601 IH title 38, United States Code) for treatment that the 1 veteran describes as being related to, or ancillary to, 2 the exposure of the veteran to toxic airborne chemi- 3 cals and fumes caused by open burn pits at any time 4 while serving in the Armed Forces. 5 (4) The term ‘‘open burn pit’’ has the meaning 6 given that term in section 201(c) of the Dignified 7 Burial and Other Veterans’ Benefits Improvement 8 Act of 2012 (Public Law 112–260;
