following bill; which was read twice and referred to the Committee on Finance
A BILL
To limit the authority of the Secretary of Labor to modify
the pandemic unemployment assistance program, and for
other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘PUA Eligibility Clari-
4
fication Act of 2021’’.
5
SEC. 2. PANDEMIC UNEMPLOYMENT ASSISTANCE.

(a) AMENDMENTS.—Section 2102(a)(3) of the
7
CARES Act (15 U.S.C. 9021(a)(3)) is amended—

(1) in subparagraph (A)(ii)(I)—

(A) in item (ii), by adding ‘‘or’’ at the end;

and
2
(B) by striking item (kk); and
3
(2) in subparagraph (B)(ii), by striking
4
‘‘through (kk)’’ and inserting ‘‘through (jj)’’.

(b) REPEAL OF GUIDANCE.—
6
(1) IN GENERAL.—The Secretary of Labor shall
7
rescind the guidance entitled, Expanded Eligibility
8
Provisions for the Pandemic Unemployment Assist-
9
ance (PUA) Program, issued on February 25, 2021.
10
(2) REPAYMENT NOT REQUIRED.—
11
(A) IN GENERAL.—Except as provided in
12
subparagraph (B), in the case of an individual
13
who received pandemic unemployment assist-
14
ance amounts pursuant to the guidance de-
15
scribed in paragraph (1) before the date of en-
16
actment of this Act, the individual shall not be
17
required to repay the amounts.

(B) EXCEPTION.—Subparagraph (A) shall
19
not apply to any individual who, as of the date
20
of enactment of this Act, was approved to re-
21
ceive compensation amounts pursuant to the
22
guidance described in paragraph (1)(A) but had
23
not yet received the amounts.
