following bill; which was referred to the Committee on Energy and Commerce
A BILL
To direct the Secretary of Health and Human Services to
submit to Congress a report on the security and resil-
ience of the United States medical supply chains, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Strengthening our
4
Health Security Through Resilient Medical Supply Chains
5
Annual Review Act of 2021’’.

SEC. 2. REPORT ON SECURITY AND RESILIENCE OF THE

UNITED STATES MEDICAL SUPPLY CHAINS.
2
(a) IN GENERAL.—Not later than one year after the
3
date of the enactment of this Act, and annually thereafter,
4
the Secretary of Health and Human Services shall submit
5
to the Committee on Energy and Commerce of the House
6
of Representatives, and the Committee on Health, Edu-
7
cation, Labor and Pensions of the Senate a report on the
8
security and resilience of the United States medical supply
9
chains. Such a report shall contain a classified annex.
10
(b) PUBLIC AVAILABILITY.—The Secretary shall—
11
(1) make publicly available (including by publi-
12
cation on the website of the Department of Health
13
and Human Services) the unclassified portion of the
14
report under subsection (a); and
15
(2) make every reasonable effort to protect
16
trade secret information and commercially confiden-
17
tial information.

(c) CONTENTS.—The report submitted under sub-
19
section (a) shall—
20
(1) review the United States supply chains for
21
medical devices, supplies, and drugs and the vulner-
22
ability of such supply chains to a global disruption,
23
such as an instance of bioterrorism, a natural dis-
24
aster, or a public health emergency;

(2) assess the dependence of the United States
1
on any medical devices, equipment, supplies, coun-
2
termeasures, vaccines, and drugs produced or
3
sourced outside the United States;
4
(3) identify the actions the Federal government
5
has taken during the year covered by the report—
6
(A) to promote the security and resilience
7
of the United States medical supply chain;
8
(B) to improve medical supply chain re-
9
dundancy;
10
(C) to encourage the domestic production
11
of medical devices, equipment, supplies, coun-
12
termeasures, vaccines, and drugs; and
13
(D) to develop contingency plans for poten-
14
tial global disruptions; and
15
(4) provide recommendations to agencies of the
16
Federal Government, States, local, tribal, and terri-
17
torial governments, and the private sector on ways
18
to strengthen the security and resilience of the
19
United States medical supply chain.
20
(d) CONSULTATION.—In preparing the report under
21
subsection (a), the Secretary of Health and Human Serv-
22
ices—
23
(1) shall consult with the heads of other rel-
24
evant Federal agencies; and

(2) may consult with public health experts,

health security experts, supply chain experts, and
2
other individuals with relevant experience.
