State Access to Firearms Evading Revocation Act

Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. PROHIBITION ON TRANSFER OF FIREARM TO PER- 1 SON WHOSE STATE LICENSE TO PURCHASE, 2 OWN, OR POSSESS A FIREARM HAS BEEN RE- 3 VOKED OR WHO HAS BEEN ORDERED BY A 4 STATE COURT TO SURRENDER ALL FIRE- 5 ARMS. 6 Section 922(d) of title 18, United States Code, is 7 amended in the first sentence— 8 (1) in paragraph (8)(B)(ii), by striking ‘‘or’’ at 9 the end; 10 (2) in paragraph (9), by striking the period at 11 the end and inserting ‘‘; or’’; and 12 (3) by adding at the end the following: 13 ‘‘(10)(A) has had a license or permit, issued by 14 a State in which the person has resided that allows 15 the person to purchase, own, or possess a firearm, 16 revoked by the State, and has not had the license or 17 permit reinstated; or 18 ‘‘(B) has been ordered by a court of such a 19 State to surrender all firearms owned or possessed 20 by the person, and has not had the firearms lawfully 21 returned.’’. 22 Æ VerDate Sep 11 2014 00:10 May 28, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6301 E:\BILLS\H2426.IH H2426 kjohnson on DSK79L0C42PROD with BILLS
