Gunnery Sergeant John David Fry Scholarship to include spouses and
children of individuals who die from a service-connected disability within
120 days of serving in the Armed Forces, and for other purposes.

To amend title 38, United States Code, to expand eligibility
for the Marine Gunnery Sergeant John David Fry Schol-
arship to include spouses and children of individuals
who die from a service-connected disability within 120
days of serving in the Armed Forces, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Fry Scholarship En-
4
hancement Act of 2021’’.

SEC. 2. EXPANSION OF ELIGIBILITY FOR MARINE GUNNERY

SERGEANT JOHN DAVID FRY SCHOLARSHIP.

(a) IN GENERAL.—Section 3311(b)(8) of title 38,
3
United States Code, is amended—
4
(1) by striking ‘‘dies in line of duty’’ and insert-
5
ing the following: ‘‘dies—
6
‘‘(A) in line of duty’’;
7
(2) in subparagraph (A), as designated by para-
8
graph (1), by striking the period at the end and in-
9
serting ‘‘; or’’; and
10
(3) by adding at the end the following new sub-
11
paragraph:

‘‘(B) from a service-connected disability
13
during the 120-day period beginning on the
14
first day immediately following the last day on
15
which the individual was discharged or released
16
from active duty as a member of the Armed
17
Forces or duty other than active duty as a
18
member of the Armed Forces, but only if—
19
‘‘(i) the person was discharged with
20
an honorable discharge; or
21
‘‘(ii) the person’s service in the Armed
22
Forces was characterized by the Secretary
23
concerned as honorable.’’.
24
(b) APPLICABILITY.—The amendments made by sub-
25
section (a) shall apply with respect to—

•S 1096 IS
(1) deaths that occur before, on, or after the
1
date of the enactment of this Act; and
2
(2) a quarter, semester, or term, as applicable,
3
commencing on or after August 1, 2023.
