Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. AFFORDABLE HOUSING INCENTIVES IN CAPITAL IN- 1 VESTMENT GRANTS. 2 Section 5309 of title 49, United States Code, is 3 amended— 4 (1) in subsection (g)— 5 (A) in paragraph (2)(B)— 6 (i) in clause (i) by striking ‘‘; and’’ 7 and inserting a semicolon; 8 (ii) in clause (ii) by striking the pe- 9 riod and inserting ‘‘; and’’; and 10 (iii) by adding at the end the fol- 11 lowing: 12 ‘‘(iii) allow a weighting of up to five 13 percentage points greater to the criteria re- 14 lating to economic development under sub- 15 section (d)(2)(A)(iii) or (e)(2)(A)(iv), as 16 applicable, and up to five percentage points 17 lesser to the lowest scoring criteria under 18 either such subsection, if the applicant 19 demonstrates substantial effort to preserve 20 or encourage affordable housing near the 21 project by— 22 ‘‘(I) providing documentation of 23 policies that allow for the approval of 24 multi-family housing, single room oc- 25 cupancy units, and accessory dwelling 26 VerDate Sep 11 2014 23:09 May 27, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2483.IH H2483 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2483 IH units without a discretionary review 1 process; 2 ‘‘(II) providing local capital 3 sources for transit-oriented develop- 4 ment; or 5 ‘‘(III) other methods, as deter- 6 mined appropriate by the Secretary.’’; 7 (B) in paragraph (3)— 8 (i) in subparagraph (C) by striking 9 ‘‘and’’ at the end; 10 (ii) by redesignating subparagraph 11 (D) as subparagraph (E); and 12 (iii) by inserting after subparagraph 13 (C) the following: 14 ‘‘(D) in the case of a warrant that applies 15 to the criteria relating to economic development 16 under subsection (d)(2)(A)(iii) or (e)(2)(A)(iv), 17 the applicant that requests the use of such war- 18 rant has completed and submitted a housing 19 feasibility assessment; and’’; and 20 (C) by adding at the end the following: 21 ‘‘(8) DEFINITION.—In this subsection, the term 22 ‘housing feasibility assessment’ means an analysis of 23 the physical, legal, and financial viability of devel- 24 VerDate Sep 11 2014 23:09 May 27, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2483.IH H2483 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2483 IH oping additional housing along a project corridor.’’; 1 and 2 (2) in subsection (l)(4)— 3 (A) in subparagraph (B) by striking ‘‘; or’’ 4 and inserting a semicolon; 5 (B) in subparagraph (C) by striking the 6 period at the end and inserting ‘‘; or’’; and 7 (C) by adding at the end the following: 8 ‘‘(D) from grant proceeds distributed 9 under section 103 of the Housing and Commu- 10 nity Development Act of 1974 (42 U.S.C. 11 5303) or section 201 of the Public Works and 12 Economic Development Act of 1965 (42 U.S.C. 13 3141), except that— 14 ‘‘(i) such proceeds are used in con- 15 junction with the planning or development 16 of affordable housing; and 17 ‘‘(ii) such affordable housing is lo- 18 cated within one-half of a mile of a new 19 defined station.’’. 20 Æ VerDate Sep 11 2014 23:09 May 27, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2483.IH H2483 kjohnson on DSK79L0C42PROD with BILLS
