A BILL
To authorize the Secretary of Housing and Urban Develop-
ment to make grants to public housing agencies and
owners of other federally assisted housing to cover the

Be it enacted by the Senate and House of Representa-
1
tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Lead Abatement for
4
Families Act of 2021’’.
5
SEC. 2. LEAD ABATEMENT FOR FAMILIES.
6
(a) IDENTIFICATION
OF LEAD WATER SERVICE
7
LINES.—

(1) REVIEW.—The Secretary of Housing and
9
Urban Development, in consultation with public
10
housing agencies, owners of other federally assisted
11
housing, and the Administrator of the Environ-
12
mental Protection Administration shall, not later
13
than the expiration of the 24-month period begin-
14
ning upon the date of the enactment of this Act, un-
15
dertake and complete a review of all public housing
16
projects and all other federally assisted housing
17
projects to identify any such projects for which the
18
source of potable water is a lead-based water service
19
pipe or pipes.
20
(2) REPORT.—Upon completion of the review
21
required under paragraph (1), the Secretary shall
22
submit a report to the Congress setting forth the re-
23
sults of the review and identifying any projects for

which the source of potable water is a lead-based

water service pipe or pipes.

(b) GRANT AUTHORITY.—
3
(1) IN
GENERAL.—The Secretary may make
4
grants to public housing agencies and owners of
5
other federally assisted housing to cover the eligible
6
costs of fully removing and replacing lead-based
7
water service pipes for housing projects identified
8
pursuant to the review under subsection (a) or oth-
9
erwise identified by the Secretary.
10
(2) ELIGIBLE COSTS.—Amounts from a grant
11
under this subsection may be used only for costs of
12
fully removing and replacing a lead-based water
13
service pipe for a housing project.
14
(3) ASSURANCES.—The Secretary shall require
15
each public housing agency and owner of other fed-
16
erally assisted housing receiving a grant under this
17
subsection for a housing project to make such assur-
18
ances and enter into such agreements as the Sec-
19
retary considers necessary to ensure that—
20
(A) the lead-based water service pipes for
21
the project that will be fully removed and re-
22
placed using such grant amounts are identified;
23
and

(B) all work to fully remove and replace
1
such pipes is completed before the expiration of
2
the 24-month period beginning upon the initial
3
availability to the agency or owner of such
4
grant amounts.
5
(4) LIMITATION ON AMOUNTS.—The amount of
6
grant under this subsection with respect to a hous-
7
ing project may not exceed the estimate of the Sec-
8
retary of the full cost of removing and replacing the
9
lead-based water service pipes for the project identi-
10
fied pursuant to paragraph (3)(A).

(c) FINAL REPORT.—Upon the expiration of the 6-
12
year period beginning on the date of the enactment of this
13
Act, the Secretary shall submit to the Congress a report
14
identifying the housing projects for which lead-based
15
water service pipes were removed and replaced using
16
grants under subsection (b) and analyzing the effective-
17
ness of the program for such grants.

(d) DEFINITIONS.—For purposes of this section, the
19
following definitions shall apply:
20
(1) HOUSING
PROJECT.—The term ‘‘housing
21
project’’ means a public housing project or a project
22
that is other federally assisted housing.
23
(2) OTHER FEDERALLY ASSISTED HOUSING.—

The term ‘‘other federally assisted housing’’ has the

meaning given the term ‘‘federally assisted housing’’
1
in section 683 of the Housing and Community De-
2
velopment Act of 1992 (42 U.S.C. 13641), except
3
that such term does not include any public housing
4
project described in paragraph (2)(A) of such sec-
5
tion.

(3) LEAD-BASED WATER SERVICE PIPE.—The
7
term ‘‘lead-based water service pipe’’ means, with re-
8
spect to a housing project, a pipe or other conduit
9
that—
10
(A) is used to supply potable water for the
11
housing project from outside the project; and
12
(B) does not satisfy the definition of ‘‘lead-
13
free’’ established under section 1417 of the Safe
14
Drinking Water Act (42 U.S.C. 300g–6).
15
(4) PUBLIC HOUSING.—The term ‘‘public hous-
16
ing’’ has the meaning given such term in section
17
3(b) of the United States Housing Act of 1937 (42
18
U.S.C. 1437a(b)).
19
(5) SECRETARY.—The term ‘‘Secretary’’ means
20
the Secretary of Housing and Urban Development.
21
(e) RULES; GUIDANCE.—The Secretary, after con-
22
sultation with the Administrator of the Environmental
23
Protection Administration, may issue any interpretative
24
rules or guidance necessary to carry out this section.

(f) AUTHORIZATION OF APPROPRIATIONS.—There is

authorized to be appropriated for grants under subsection
2
(b)—
3
(1) $90,000,000 for fiscal year 2022;
4
(2) $80,000,000 for fiscal year 2023; and
5
(3) $80,000,000 for fiscal year 2024.
