Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Kids In-Person Deter- 4 mines School Success Act’’ or the ‘‘KIDS Success Act’’. 5 SEC. 2. REPORTS AND ASSESSMENT ON IMPACT OF 6 SCHOOL CLOSURES DUE TO COVID–19. 7 (a) LEA INFORMATION COLLECTION.—Not later 8 than 60 days after the date of enactment of this Act, each 9 VerDate Sep 11 2014 08:50 May 28, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2520.IH H2520 kjohnson on DSK79L0C42PROD with BILLS 2 •HR 2520 IH local educational agency that received funds under section 1 2001 of the American Rescue Plan Act of 2021 (Public 2 Law 117–2) shall submit to the Secretary of Education 3 a report that includes the following: 4 (1) With respect to each unopened school in the 5 jurisdiction of such agency— 6 (A) an explanation of the reasons such 7 school has not opened for full-time, in-person 8 learning in accordance with the guidance of the 9 Centers for Disease Control titled ‘‘Operational 10 Strategy for K–12 Schools through Phased Pre- 11 vention’’, as updated on March 19, 2021; and 12 (B) the expected date on which students 13 are expected to return to such school for full- 14 time, in-person learning. 15 (2) The total amount of Federal COVID–19 re- 16 lief funds received by the local educational agency in 17 the preceding 12 months. 18 (3) Such other information as the Secretary of 19 Education may require. 20 (b) ASSESSMENT AND REPORT.— 21 (1) ASSESSMENT.—Using the information re- 22 ceived from local educational agencies under sub- 23 section (a) and other available research and informa- 24 tion, the Secretary of Education shall conduct an as- 25 VerDate Sep 11 2014 08:50 May 28, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2520.IH H2520 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2520 IH sessment of the effects of school closures due to 1 COVID–19, including— 2 (A) the long-term effects of extended e- 3 learning and hybrid learning on students; 4 (B) the effect of such closures on student 5 absenteeism and disciplinary changes; and 6 (C) any other effects the Secretary deter- 7 mines to be relevant. 8 (2) REPORT.—Not later than 180 days after 9 the date of enactment of this Act, the Secretary of 10 Education shall submit to Congress a report on the 11 results of the assessment conducted under para- 12 graph (1). 13 (c) DEFINITIONS.—In this Act: 14 (1) The term ‘‘unopened school’’ means an ele- 15 mentary school or secondary school that is not open 16 for full-time, in-person learning as of April 5, 2021. 17 (2) The terms ‘‘elementary school’’, ‘‘local edu- 18 cational agency’’, and ‘‘secondary school’’ have the 19 meanings given those terms in section 8101 if the 20 Elementary and Secondary Education Act of 1965 21 (20 U.S.C. 7801). 22 Æ VerDate Sep 11 2014 08:50 May 28, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2520.IH H2520 kjohnson on DSK79L0C42PROD with BILLS
