Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Promoting Election 4 Integrity by Proving Voter Identity Act’’. 5 SEC. 2. PROMOTING INTEGRITY IN CASTING OF BAL- 5 LOTS. 6 ‘‘(a) REQUIRING PROVISION OF IDENTIFICATION AS 7 CONDITION OF VOTING.— 8 ‘‘(1) INDIVIDUALS VOTING IN PERSON.—Not- 9 withstanding any other provision of law, the appro- 10 priate State or local election official may not provide 11 a ballot for an election for Federal office to an indi- 12 vidual who desires to vote in person unless the indi- 13 vidual presents to the official a current and valid 14 identification. 15 ‘‘(2) INDIVIDUALS VOTING OTHER THAN IN 16 PERSON.—Notwithstanding any other provision of 17 law, the appropriate State or local election official 18 may not accept any ballot for an election for Federal 19 office provided by an individual who votes other than 20 in person unless the individual submits with the bal- 21 lot a copy of a current and valid identification. 22 ‘‘(3) CURRENT AND VALID IDENTIFICATION DE- 23 FINED.—In this subsection, a ‘current and valid 24 VerDate Sep 11 2014 05:37 Apr 27, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S1130.IS S1130 kjohnson on DSK79L0C42PROD with BILLS 3 •S 1130 IS identification’ means a current and valid version of 1 any of the following: 2 ‘‘(A) An identification issued by a State or 3 a unit of local government in a State. 4 ‘‘(B) A United States passport. 5 ‘‘(C) A military identification card. 6 ‘‘(D) An identification issued by a tribal 7 government. 8 ‘‘(b) EXCEPTION FOR ABSENT MILITARY AND OVER- 9 SEAS VOTERS.—This section does not apply with respect 10 to any individual who is entitled to vote by absentee ballot 11 under the Uniformed and Overseas Citizens Absentee Vot- 12 ing Act (52 U.S.C. 20301 et seq.). 13 ‘‘(c) EFFECTIVE DATE.—This section shall apply 14 with respect to the regularly scheduled general election for 15 Federal office held in 2022 and any succeeding election 16 for Federal office.’’. 17 (b) CONFORMING AMENDMENT RELATING TO EXIST- 18 ING IDENTIFICATION REQUIREMENTS.—Section 303 of 19 such Act (52 U.S.C. 21083) is amended by striking sub- 20 section (b). 21 (c) CONFORMING AMENDMENT RELATING TO EN- 22 FORCEMENT.—Section 401 of such Act (52 U.S.C. 21111) 23 is amended by striking ‘‘and 303’’ and inserting ‘‘303, and 24 304’’. 25 VerDate Sep 11 2014 05:37 Apr 27, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S1130.IS S1130 kjohnson on DSK79L0C42PROD with BILLS 4 •S 1130 IS (d) CLERICAL AMENDMENT.—The table of contents 1 of such Act is amended— 2 (1) by redesignating the items relating to sec- 3 tions 304 and 305 as relating to sections 305 and 4 306; and 5 (2) by inserting after the item relating to sec- 6 tion 303 the following: 7 ‘‘Sec. 304.
