A BILL
To distribute certain unobligated COVID–19 relief funds to
States on the basis of the number of school-aged children
in each State.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Protecting Every Stu-
4
dent Act’’.

SEC. 2. USE OF UNOBLIGATED RELIEF FUNDS.

Any Federal funds made available to the Secretary
7
of Education on an emergency or supplemental basis to
8
prevent, prepare for, or respond to the coronavirus pan-
9
demic, which as of the date of enactment of this Act, re-

main unobligated shall be distributed to each State on the

basis of the number of children aged 5 through 17 in such

State counted in the most recent census data approved
3
by the Secretary of Education, as compared to the number
4
of such children in all States.
