Be it enacted by the Senate and House of Representa-
1
tives of the United States of America in Congress assembled,
2
SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Truck Parking Safety
4
Improvement Act’’.
5
SEC. 2. SENSE OF CONGRESS.
6
It is the sense of Congress that it should be a national
7
priority to address the shortage of parking for commercial
8
motor vehicles on the Federal-aid highway system to im-
9
prove highway safety.
10
SEC. 3. PARKING FOR COMMERCIAL MOTOR VEHICLES.
11
(a) IN GENERAL.—Chapter 1 of title 23, United States
12
Code, is amended by adding at the end the following:
13
‘‘§ 177. Parking for commercial motor vehicles
14
‘‘(a) GRANT AUTHORITY.—Subject to the availability
15
of funds, the Secretary shall make grants under this section,
16
on a competitive basis, to eligible entities for projects to pro-
17
vide parking for commercial motor vehicles and improve
18
the safety of commercial motor vehicle operators.
19
‘‘(b) APPLICATIONS.—To be eligible for a grant under
20
this section, an eligible entity shall submit to the Secretary
21
an application at such time and in such manner as the
22
Secretary may require.
23
‘‘(c) APPLICATION CONTENTS.—An application sub-
24
mitted under subsection (b) shall contain—

‘‘(1) a description of the proposed project; and
1
‘‘(2) any other information that the Secretary
2
may require.
3
‘‘(d) ELIGIBLE ENTITIES.—The following entities shall
4
be eligible to receive amounts under this section:
5
‘‘(1) A State.
6
‘‘(2) A metropolitan planning organization.
7
‘‘(3) A unit of local government.
8
‘‘(4) A political subdivision of a State or local
9
government carrying out responsibilities relating to
10
commercial motor vehicle parking.
11
‘‘(5) A Tribal government or a consortium of
12
Tribal governments.
13
‘‘(6) A multistate or multijurisdictional group of
14
entities described in paragraphs (1) through (5).
15
‘‘(e) PRIVATE SECTOR PARTICIPATION.—An eligible
16
entity that receives a grant under this section may partner
17
with a private entity to carry out an eligible project under
18
this section.
19
‘‘(f) ELIGIBLE PROJECTS.—
20
‘‘(1) IN GENERAL.—An entity may use a grant
21
awarded under this section for a project described in
22
paragraph (2) that is on—
23
‘‘(A) a Federal-aid highway; or
24
‘‘(B) a facility with reasonable access to—

‘‘(i) a Federal-aid highway; or
1
‘‘(ii) a freight facility.
2
‘‘(2) PROJECTS DESCRIBED.—A project described
3
in this paragraph is a project to—
4
‘‘(A) construct safety rest areas (as such
5
term is defined in section 120(c)) that include
6
parking for commercial motor vehicles;
7
‘‘(B) construct additional commercial motor
8
vehicle parking capacity—
9
‘‘(i) adjacent to private commercial
10
truck stops and travel plazas;
11
‘‘(ii) within the boundaries of, or adja-
12
cent to, a publicly owned freight facility,
13
including a port terminal operated by a
14
public authority; and
15
‘‘(iii) at existing facilities, including
16
inspection and weigh stations and park-
17
and-ride locations;
18
‘‘(C) open existing weigh stations, safety
19
rest areas, and park-and-ride facilities to com-
20
mercial motor vehicle parking;
21
‘‘(D) construct or make capital improve-
22
ments to existing public commercial motor vehi-
23
cle parking facilities to expand parking utiliza-

tion and availability, including at seasonal fa-
1
cilities;
2
‘‘(E) identify, promote, and manage the
3
availability of publicly and privately provided
4
commercial motor vehicle parking, such as
5
through the use of intelligent transportation sys-
6
tems;
7
‘‘(F) improve the safety of commercial
8
motor vehicle operators at parking facilities as
9
part of a project described in subparagraphs (A)
10
through (D); or
11
‘‘(G) improve a parking facility, including
12
through truck stop electrification systems, as de-
13
fined in section 101(a), and other improvements
14
determined appropriate by the Secretary, as part
15
of a project described in subparagraphs (A)
16
through (D).
17
‘‘(3) PUBLICLY ACCESSIBLE PARKING.—Commer-
18
cial motor vehicle parking constructed or opened with
19
a grant under this section shall be open and accessible
20
to all commercial motor vehicle operators.
21
‘‘(g) USE OF FUNDS.—
22
‘‘(1) IN GENERAL.—An eligible entity may use a
23
grant under this section for—

‘‘(A) development phase activities, including
1
planning, feasibility analysis, benefit-cost anal-
2
ysis, environmental review, preliminary engi-
3
neering
and
design
work,
and
other
4
preconstruction activities necessary to advance a
5
project under this section; and
6
‘‘(B) construction and operational improve-
7
ments.
8
‘‘(2) LIMITATION.—
9
‘‘(A) IN GENERAL.—An eligible entity may
10
use not more than 25 percent of the amount of
11
a grant under this section for activities described
12
in paragraph (1)(A).
13
‘‘(B) EXISTING FACILITIES.—Not more than
14
10 percent of the amounts available for each fis-
15
cal year for grants under the program may be
16
used for projects described under subsection
17
(f)(2)(E) that solely identify, promote, and man-
18
age the availability of existing commercial motor
19
vehicle parking.
20
‘‘(h) SELECTION CRITERIA.—In making grants under
21
this subsection, the Secretary shall give priority to applica-
22
tions that demonstrate—

‘‘(1) a shortage of commercial motor vehicle
1
parking capacity in the corridor in which the project
2
is located;
3
‘‘(2) consultation with motor carriers, commer-
4
cial motor vehicle operators, public safety officials,
5
and private providers of commercial motor vehicle
6
parking;
7
‘‘(3) that the project will likely—
8
‘‘(A) increase the availability or utilization
9
of commercial motor vehicle parking;
10
‘‘(B) facilitate the efficient movement of
11
freight; and
12
‘‘(C) improve highway safety, traffic conges-
13
tion, and air quality; and
14
‘‘(4) the ability to provide for the maintenance
15
and operation of the facility.
16
‘‘(i) FEDERAL SHARE.—Notwithstanding section 120,
17
the Federal share for a project carried out under this sub-
18
section shall be up to 100 percent.
19
‘‘(j) TREATMENT OF PROJECTS.—
20
‘‘(1) IN GENERAL.—Notwithstanding any other
21
provision of law, projects funded under this section
22
shall be treated as projects on a Federal-aid highway
23
under this chapter.

‘‘(2) PERIOD OF AVAILABILITY.—Funds appro-
1
priated for projects under this section shall remain
2
available for a period of 3 years after the last day of
3
the fiscal year in which the funds are made available.
4
‘‘(k) PROHIBITION ON CHARGING FEES.—To be eligi-
5
ble for a grant under this section, an eligible entity shall
6
agree that no fees will be charged to a commercial motor
7
vehicle to access parking constructed, opened, or improved
8
with a grant under this section.
9
‘‘(l) NOTIFICATION OF CONGRESS.—Not less than 3
10
business days before making a grant for a project under
11
this section, the Secretary shall notify, in writing, the Com-
12
mittee on Transportation and Infrastructure of the House
13
of Representatives and the Committee on the Environment
14
and Public Works of the Senate of the intention to award
15
such a grant.

‘‘(m) SURVEY AND COMPARATIVE ASSESSMENT.—
17
‘‘(1) IN GENERAL.—Not later than 18 months
18
after the date of enactment of this subsection, and
19
every 2 years thereafter, the Secretary, in consultation
20
with appropriate State motor carrier safety per-
21
sonnel, motor carriers, State departments of transpor-
22
tation, and private providers of commercial motor ve-
23
hicle parking shall submit to the Committee on
24
Transportation and Infrastructure of the House of

Representatives and the Committee on the Environ-
1
ment and Public Works of the Senate a report that—
2
‘‘(A) evaluates the availability of adequate
3
parking and rest facilities, taking into account
4
both private and public facilities, for commercial
5
motor vehicles engaged in interstate transpor-
6
tation;
7
‘‘(B) evaluates the effectiveness of the
8
projects funded under this section in improving
9
access to commercial motor vehicle parking;
10
‘‘(C) evaluates the ability of entities receiv-
11
ing a grant under this section to sustain the op-
12
eration of parking facilities constructed with
13
funds provided under this section; and
14
‘‘(D) reports on the progress being made to
15
provide adequate commercial motor vehicle park-
16
ing facilities in the State.
17
‘‘(2) RESULTS.—The Secretary shall make the
18
report and subsequent updated reports under para-
19
graph (1) available to the public on the website of the
20
Department of Transportation.
21
‘‘(3) ALIGNMENT OF REPORTS.—In carrying out
22
this subsection, the Secretary shall consider the results
23
of the commercial motor vehicle parking facilities as-
24
sessments of the States under section 70202 of title 49

and seek to align the contents of the report and re-
1
porting deadlines under paragraph (1) with the re-
2
quirements of such section.

‘‘(n) COMMERCIAL MOTOR VEHICLE DEFINED.—In
4
this section, the term ‘commercial motor vehicle’ has the
5
meaning given such term in section 31132 of title 49.’’.
6
(b) CLERICAL AMENDMENT.—The analysis for chapter
7
1 of title 23, United States Code, is amended by adding
8
after the item relating to section 176 the following:
9
‘‘177. Parking for commercial motor vehicles.’’.
SEC. 4. AUTHORIZATION OF APPROPRIATIONS.
10
There are authorized to be appropriated out of the gen-
11
eral fund of the Treasury for projects for commercial vehicle
12
parking under section 177 of title 23, United States Code
13
(as added by this Act)—
14
(1) $175,000,000 for fiscal year 2023;
15
(2) $185,000,000 for fiscal year 2024;
16
(3) $195,000,000 for fiscal year 2025; and
17
(4) $200,000,000 for fiscal year 2026.
18
SEC. 5. PROHIBITION ON USE OF FUNDS.
19
None of the funds made available to carry out the
20
Truck Parking Safety Improvement Act, or the amendments
21
made by such Act, may be used for electric vehicle or electric
22
truck charging.
