DESIGNATION OF HONOR AND REMEMBER FLAG 1 FOR FALLEN MEMBERS OF THE ARMED 2 FORCES. 3 (a) FINDINGS.—Congress finds the following: 4 (1) Since the Revolutionary War, more than 5 one million members of the United States Armed 6 Forces have paid the ultimate price by sacrificing 7 their lives in the line of duty. 8 (2) The contributions of those fallen members 9 of the Armed Forces are deserving of national rec- 10 ognition. 11 (3) Currently, there is no officially recognized 12 symbol that acknowledges members of the Armed 13 Forces who died in the line of duty. 14 (b) DESIGNATION.—Chapter 9 of title 36, United 15 States Code, is amended by adding at the end the fol- 16 lowing new section: 17 ‘‘§ 904. Honor and Remember Flag for fallen members 18 of the Armed Forces 19 ‘‘(a) DESIGNATION.—The Honor and Remember 20 Flag created by Honor and Remember, Inc., is designated 21 as the symbol of our Nation’s concern and commitment 22 to honoring and remembering the lives of all members of 23 the United States Armed Forces who have lost their lives 24 in the line of duty. 25 VerDate Sep 11 2014 23:48 May 26, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2331.IH H2331 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2331 IH ‘‘(b) REQUIRED DISPLAY.—(1) The Honor and Re- 1 member Flag shall be displayed at the locations specified 2 in subsection (c) on the days specified in paragraph (2). 3 ‘‘(2) The required Honor and Remember Flag display 4 days are the following: 5 ‘‘(A) Armed Forces Day, the third Saturday in 6 May. 7 ‘‘(B) Memorial Day, the last Monday in May. 8 ‘‘(C) Flag Day, June 14. 9 ‘‘(D) Independence Day, July 4. 10 ‘‘(E) National POW/MIA Recognition Day. 11 ‘‘(F) Veterans Day, November 11. 12 ‘‘(3) In addition to the days specified in paragraph 13 (2), Honor and Remember Flag display days include— 14 ‘‘(A) in the case of display at the World War 15 II Memorial, Korean War Veterans Memorial, and 16 Vietnam Veterans Memorial (required by subsection 17 (c)(3)), any day on which the flag of the United 18 States is displayed; 19 ‘‘(B) in the case of display at medical centers 20 of the Department of Veterans Affairs (required by 21 subsection (c)(7)), any day on which the flag of the 22 United States is displayed; and 23 ‘‘(C) in the case of display at United States 24 Postal Service post offices (required by subsection 25 VerDate Sep 11 2014 23:48 May 26, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2331.IH H2331 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2331 IH (c)(8)), the last business day before a day specified 1 in paragraph (2) that in any year is not itself a 2 business day. 3 ‘‘(c) LOCATIONS FOR FLAG DISPLAY.—The locations 4 for the display of the Honor and Remember Flag under 5 subsection (b) are the following: 6 ‘‘(1) The Capitol. 7 ‘‘(2) The White House. 8 ‘‘(3) The World War II Memorial, the Korean 9 War Veterans Memorial, and the Vietnam Veterans 10 Memorial. 11 ‘‘(4) Each national cemetery. 12 ‘‘(5) The buildings containing the official office 13 of— 14 ‘‘(A) the Secretary of State; 15 ‘‘(B) the Secretary of Defense; 16 ‘‘(C) the Secretary of Veterans Affairs; 17 and 18 ‘‘(D) the Director of the Selective Service 19 System. 20 ‘‘(6) Each major military installation, as des- 21 ignated by the Secretary of Defense. 22 ‘‘(7) Each medical center of the Department of 23 Veterans Affairs. 24 VerDate Sep 11 2014 23:48 May 26, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2331.IH H2331 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 2331 IH ‘‘(8) Each United States Postal Service post of- 1 fice. 2 ‘‘(d) DISPLAY TO BE IN A MANNER VISIBLE TO THE 3 PUBLIC.—Display of the Honor and Remember Flag pur- 4 suant to this section shall be in a manner designed to en- 5 sure visibility to the public. 6 ‘‘(e) LIMITATION.—This section may not be con- 7 strued or applied so as to require any employee to report 8 to work solely for the purpose of providing for the display 9 of the Honor and Remember Flag or any other flag.’’. 10 (c) CLERICAL AMENDMENT.—The table of sections 11 at the beginning of such chapter is amended by adding 12 at the end the following new item: 13 ‘‘904. Honor and Remember Flag for fallen members of the Armed Forces.’’.
