Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. REPEAL OR MODIFICATION OF REGULATIONS DUR- 1 ING THE EMERGENCY PERIOD. 2 Any regulation waived or modified during the emer- 3 gency period shall be repealed or modified, as applicable, 4 the day after the expiration of the emergency period and 5 thereafter, unless a Federal Regulatory Review Commis- 6 sion recommends the regulation should not be repealed or 7 modified, as applicable, and a law is enacted confirming 8 the recommendation. 9 SEC. 3. FEDERAL REGULATORY REVIEW COMMISSIONS. 10 (a) ESTABLISHMENT.—There are established Com- 11 missions to be known as the ‘‘Federal Regulatory Review 12 Commissions’’. 13 (b) MEMBERS.—Each Commission shall be composed 14 of members of the congressional committee of each juris- 15 diction and the head of each agency under the jurisdiction 16 of that committee (in this Act referred to as the ‘‘mem- 17 bers’’). 18 (c) INFORMATION.—Members may obtain informa- 19 tion from individuals with expertise in the operations and 20 regulations of government programs. 21 (d) DUTIES OF THE COMMISSIONS.— 22 (1) REVIEW OF FEDERAL REGULATIONS.—Not 23 later than 2 months after the date of the enactment 24 of this Act, each Commission shall submit to the 25 Speaker of the House of Representatives and the 26 VerDate Sep 11 2014 01:27 May 26, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2251.IH H2251 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 2251 IH majority leader of the Senate an official rec- 1 ommendation, on the repeal or modification of each 2 regulation waived or modified during the emergency 3 period. Each regulation waived or modified during 4 the emergency period shall remain waived or modi- 5 fied, as applicable, during the review period by the 6 Commission. 7 (2) EXTENSION.—The deadline in paragraph 8 (1) may be extended for an additional month if the 9 Congress enacts legislation extending such deadline 10 by a vote of a majority of the House of Representa- 11 tives and the Senate. 12 (e) REPORT TO CONGRESS.— 13 (1) AGENCY REPORT ON REGULATIONS.—Not 14 later than 1 month after the date of the enactment 15 of this Act, the head of each agency shall submit to 16 each congressional committee of jurisdiction a report 17 that includes— 18 (A) an analysis of whether or not the agen- 19 cy can function without the regulation or with 20 the modified regulation, as applicable; and 21 (B) an analysis of whether the regulation 22 should be restored to its original state before 23 the emergency period or should remain repealed 24 or modified, as applicable. 25 VerDate Sep 11 2014 01:27 May 26, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2251.IH H2251 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 2251 IH (2) PUBLIC COMMENT PERIOD REQUIRED.—The 1 head of an agency shall provide a public comment 2 period before submitting a report pursuant to para- 3 graph (1). 4 (f) CONGRESSIONAL RECOMMENDATION.—Not later 5 than 1 month after receiving a report from the head of 6 each agency pursuant to subsection (e), each committee 7 shall submit to the Speaker of the House of Representa- 8 tives and the majority leader of the Senate an official rec- 9 ommendation on whether or not the repealed or modified 10 regulation should be re-established. 11 (g) SUNSET OF COMMISSIONS.—The Commissions 12 established in this section shall terminate on the final day 13 of the final recommendation by each committee. 14 SEC. 4.
