To provide for a 3-month delay for the recoupment of certain payments
made under the accelerated or advance payment programs under the
Medicare program.

Mr. ISSA (for himself, Mr. LEVIN of California, Mr. CALVERT, and Mr.
CORREA) introduced the following bill; which was referred to the Com-
mittee on Ways and Means, and in addition to the Committee on Energy
and Commerce, for a period to be subsequently determined by the Speak-
er, in each case for consideration of such provisions as fall within the ju-
risdiction of the committee concerned
A BILL
To provide for a 3-month delay for the recoupment of certain
payments made under the accelerated or advance pay-
ment programs under the Medicare program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Better Way for Pro-
4
viders To Repay Act of 2021’’.

SEC. 2. PROVIDING FOR A 3-MONTH DELAY FOR THE

RECOUPMENT OF CERTAIN PAYMENTS MADE
2
UNDER THE ACCELERATED OR ADVANCE
3
PAYMENT PROGRAMS UNDER THE MEDICARE
4
PROGRAM.

(a) PART A.—Section 1815(f)(2)(C) of the Social Se-
6
curity Act (42 U.S.C. 1395g(f)(2)(C)) is amended—
7
(1) in clause (i), by striking ‘‘1 year’’ and in-
8
serting ‘‘15 months’’;
9
(2) in clause (ii)(II), by striking ‘‘and’’ at the
10
end;
11
(3) in clause (iii), by striking the period and in-
12
serting ‘‘; and’’; and
13
(4) by adding at the end the following new
14
clause:
15
‘‘(iv) in the case such hospital has
16
submitted any payment to the Secretary
17
for payments under such program, suspend
18
any offset described in clause (i) for a pe-
19
riod of time such that the aggregate
20
amount of any payments so submitted
21
equals the aggregate amount of such off-
22
sets that would have been made during
23
such period had this clause not applied.’’.

(b) PART B.—Section 2501(a)(2)(A) of the Con-

tinuing Appropriations Act, 2021 and Other Extensions
2
Act (Public Law 116–159) is amended—
3
(1) in clause (i), by striking ‘‘1 year’’ and in-
4
serting ‘‘15 months’’;
5
(2) in clause (ii)(II), by striking ‘‘and’’ at the
6
end;
7
(3) in clause (iii), by striking the period and in-
8
serting ‘‘; and’’; and
9
(4) by adding at the end the following new
10
clause:

‘‘(iv) in the case such provider or sup-
12
plier has submitted any payment to the
13
Secretary for payments under such pro-
14
gram, suspend any offset described in
15
clause (i) for a period of time such that
16
the aggregate amount of any payments so
17
submitted equals the aggregate amount of
18
such offsets that would have been made
19
during such period had this clause not ap-
20
plied.’’.
