Mr. KELLY of Pennsylvania (for himself and Mr. O’HALLERAN) introduced
the following bill; which was referred to the Committee on Ways and
Means, and in addition to the Committee on Energy and Commerce, for
a period to be subsequently determined by the Speaker, in each case for
consideration of such provisions as fall within the jurisdiction of the com-
mittee concerned
A BILL
To amend title XVIII of the Social Security Act to require
the inclusion of information on prior authorization re-
quirements and other utilization management techniques
in the Medicare & You annual notice.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Medicare & You Hand-
4
book Improvement Act of 2021’’.

OTHER UTILIZATION MANAGEMENT TECH-

NIQUES IN THE MEDICARE & YOU ANNUAL

NOTICE.

(a) IN GENERAL.—Section 1804(c) of the Social Se-
6
curity Act (42 U.S.C. 1395b–2(c)) is amended—
7
(1) in paragraph (3), by striking ‘‘and’’ at the
8
end;
9
(2) in paragraph (4), by striking the period at
10
the end and inserting ‘‘; and’’; and
11
(3) by adding at the end the following new
12
paragraph:

‘‘(5) a description of the types of prior author-
14
ization requirements and any other utilization man-
15
agement techniques that may apply under this title,
16
including information on how an individual may find
17
out which such requirements and techniques (if any)
18
apply under a Medicare Advantage plan or a pre-
19
scription drug plan.’’.
20
(b) EFFECTIVE DATE.—The amendments made by
21
subsection (a) shall apply to notices distributed on or after
22
January 1, 2022.
