To prohibit airlines and Amtrak from conditioning the provision of transpor-
tation services to any individual on such individual having been vac-
cinated against COVID–19, and for other purposes.

Mr. LAMALFA introduced the following bill; which was referred to the Com-
mittee on Transportation and Infrastructure, and in addition to the Com-
mittee on Energy and Commerce, for a period to be subsequently deter-
mined by the Speaker, in each case for consideration of such provisions
as fall within the jurisdiction of the committee concerned
A BILL
To prohibit airlines and Amtrak from conditioning the provi-
sion of transportation services to any individual on such
individual having been vaccinated against COVID–19,
and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. CERTAIN COVID VACCINATION REQUIREMENTS

PROHIBITED.

(a) AIRLINES.—The Secretary of Transportation,
5
acting through the Administrator of the Federal Aviation
6
Administration, shall prohibit air carriers (as such term

is defined in section 40102(a) of title 49, United States

Code) from denying an individual air transportation solely
2
because such individual has not been vaccinated against
3
COVID–19.

(b) AMTRAK.—Amtrak may not deny an individual
5
passenger rail transportation solely because such indi-
6
vidual has not been vaccinated against COVID–19.
7
(c) FUNDING PROHIBITIONS.—No Federal funds
8
may be obligated or expended—
9
(1) to create, administer, or mandate the cre-
10
ation of a database of individuals who have been
11
vaccinated against COVID–19; and
12
(2) by any Federal agency (as defined in sec-
13
tion 105 of title 5, United States Code) to develop,
14
implement, or enforce any Federal law, rule, regula-
15
tion, guidance, or policy denying any individual ac-
16
cess to transportation or otherwise restricting or
17
preventing any individual from traveling solely be-
18
cause such individual has not been vaccinated
19
against COVID–19.
