term care facilities to report certain information relating to COVID-
19 cases and deaths.

Mr. HORSFORD (for himself, Mr. BISHOP of Georgia, and Mrs. DEMINGS) in-
troduced the following bill; which was referred to the Committee on Ways
and Means, and in addition to the Committee on Energy and Commerce,
for a period to be subsequently determined by the Speaker, in each case
for consideration of such provisions as fall within the jurisdiction of the
committee concerned
A BILL
To direct the Secretary of Health and Human Services to
require long-term care facilities to report certain infor-
mation relating to COVID-19 cases and deaths.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Nursing Facility Qual-
4
ity Reporting Act of 2021’’.

SEC. 2. REQUIRING LONG-TERM CARE FACILITIES TO RE-

PORT CERTAIN INFORMATION RELATING TO
2
COVID-19 CASES AND DEATHS.

(a) IN GENERAL.—The Secretary of Health and
4
Human Services (in this section referred to as the ‘‘Sec-
5
retary’’) shall, as soon as practicable, require that the in-
6
formation described in paragraph (1) of section 483.80(g)
7
of title 42, Code of Federal Regulations, or a successor
8
regulation, be reported by a facility (as defined for pur-
9
poses of such section).

(b) DEMOGRAPHIC INFORMATION.—The Secretary
11
shall post the following information with respect to skilled
12
nursing facilities (as defined in section 1819(a) of the So-
13
cial Security Act (42 U.S.C. 1395i–3(a))) and nursing fa-
14
cilities (as defined in section 1919(a) of such Act (42
15
U.S.C. 1396r(a))) on the Nursing Home Compare website
16
(as described in section 1819(i) of the Social Security Act
17
(42 U.S.C. 1395i–3(i))), or a successor website, aggre-
18
gated by State:
19
(1) The age, race/ethnicity, and preferred lan-
20
guage of the residents of such skilled nursing facili-
21
ties and nursing facilities with suspected or con-
22
firmed COVID-19 infections, including residents
23
previously treated for COVID-19.
24
(2) The age, race/ethnicity, and preferred lan-
25
guage relating to total deaths and COVID-19 deaths

(c) CONFIDENTIALITY.—Any information reported
3
under this section that is made available to the public shall
4
be made so available in a manner that protects the identity
5
of residents of skilled nursing facilities and nursing facili-
6
ties.

(d) IMPLEMENTATION.—The Secretary may imple-
8
ment the provisions of this section by program instruction
9
or otherwise.
