Mr. CRUZ (for himself, Mr. KENNEDY, and Mr. CRAMER) introduced the fol-
lowing bill; which was read twice and referred to the Committee on Com-
merce, Science, and Transportation
A BILL
To prohibit the Secretary of Transportation from prohibiting
the transportation of liquefied natural gas by rail, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. LIQUEFIED NATURAL GAS BY RAIL.

(a) IN GENERAL.—The Secretary of Transportation
4
may not issue any regulation or long-term order that—
5
(1) prohibits the transportation of methane, re-
6
frigerated liquid (commonly known as ‘‘liquefied nat-
7
ural gas’’ or ‘‘LNG’’) by rail; or

(2) restricts or contracts the scope of allowance

provided by the final rule of the Pipeline and Haz-
2
ardous Materials Safety Administration, titled ‘‘Haz-
3
ardous Materials: Liquefied Natural Gas by Rail’’,
4
which was published in the Federal Register on July
5
24, 2020 (85 Fed. Reg. 44994).

(b) RULE OF CONSTRUCTION.—Nothing in this sec-
7
tion may be construed to limit the authority of the Sec-
8
retary of Transportation to issue short-term emergency
9
orders related to the transportation of liquefied natural
10
gas by rail.
