A BILL
To direct the Secretary of Transportation to establish a
Motorcyclist Advisory Council, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Motorcyclist Advisory
4
Council Reauthorization Act’’.
5
SEC. 2. MOTORCYCLIST ADVISORY COUNCIL.
6
(a) ESTABLISHMENT.—Not later than 90 days after
7
the date of enactment of this Act, the Secretary shall es-

tablish a Motorcyclist Advisory Council (in this section re-
1
ferred to as the ‘‘Council’’).
2
(b) DUTIES.—
3
(1) ADVISING.—The Council shall advise the
4
Secretary, the Administrator of the National High-
5
way Traffic Safety Administration, and the Adminis-
6
trator of the Federal Highway Administration on
7
transportation issues of concern to motorcyclists, in-
8
cluding—
9
(A) barrier design;
10
(B) road design, construction, and mainte-
11
nance practices; and
12
(C) the architecture and implementation of
13
intelligent transportation system technologies.
14
(2) BIENNIAL COUNCIL REPORT.—
15
(A) IN GENERAL.—The Council shall sub-
16
mit a report to the Secretary containing the
17
Council’s recommendations on the issues de-
18
scribed in paragraph (1).
19
(B) TIMING.—Not later than October 31
20
of the calendar year following the calendar year
21
in which the Council is established, and by
22
every 2nd October 31 thereafter, the Council
23
shall submit the report described in subpara-
24
graph (A).

(c) MEMBERSHIP.—
1
(1) IN GENERAL.—The Council shall be com-
2
prised of 13 members appointed by the Secretary as
3
follows:
4
(A) Five experts from State or local gov-
5
ernment on highway engineering issues, includ-
6
ing—
7
(i) barrier design;
8
(ii) road design, construction, and
9
maintenance; or
10
(iii) intelligent transportation systems.
11
(B) One State or local traffic and safety
12
engineer, design engineer, or other transpor-
13
tation department official who is a motorcyclist.
14
(C) One representative from a national as-
15
sociation of State transportation officials.
16
(D) One representative from a national
17
motorcyclist association.
18
(E) One representative from a national
19
motorcyclist foundation.
20
(F) One representative from a national
21
motorcycle manufacturing association.
22
(G) One representative from a motorcycle
23
manufacturing company headquartered in the
24
United States.

(H) One roadway safety data expert on
1
crash testing and analysis.
2
(I) One member of a national safety orga-
3
nization that represents the traffic safety sys-
4
tems industry.
5
(2) DURATION.—
6
(A) TERM.—Subject to subparagraphs (B)
7
and (C), each member shall serve one term of
8
2 years.
9
(B) ADDITIONAL TERMS.—If a successor is
10
not designated for a member before the expira-
11
tion of the term the member is serving, the
12
member may serve another term.
13
(C) APPOINTMENT OF REPLACEMENTS.—If
14
a member resigns before serving a full 2-year
15
term, the Secretary may appoint a replacement
16
for such member to serve the remaining portion
17
such term. A member may continue to serve
18
after resignation until a successor has been ap-
19
pointed. A vacancy in the Council shall be filled
20
in the manner in which the original appoint-
21
ment was made.

(3)
COMPENSATION.—Members
shall
serve

without compensation.

(d) TERMINATION.—The Council shall terminate 6

years after the date of its establishment.

SEC. 3. DUTIES OF THE SECRETARY.
3
(a) ACCEPT OR REJECT RECOMMENDATION.—
4
(1) DETERMINATION.—The Secretary shall de-
5
termine whether to accept or reject a recommenda-
6
tion contained in a Council report.
7
(2) TIMING.—
8
(A) ACCEPT OR REJECT.—The Secretary
9
shall indicate in each report submitted under
10
this section the Secretary’s acceptance or rejec-
11
tion of each recommendation listed in such re-
12
port.
13
(B) UNDER
CONSIDERATION.—The Sec-
14
retary may state in a report submitted under
15
this section that a recommendation is under
16
consideration. If the Secretary so states, the
17
Secretary shall accept or reject the rec-
18
ommendation in the next report submitted
19
under this section.
20
(b) REPORT.—
21
(1) IN GENERAL.—Not later than 60 days after
22
the Secretary receives a Council report, the Sec-
23
retary shall submit a report to the following:

(2) CONTENTS.—A report submitted under this

subsection shall include—

(A) a list containing—

(i) each recommendation contained in
18
the Council report described in paragraph
19
(1); and
20
(ii) each recommendation stated as
21
under consideration in the previous report
22
submitted under this subsection; and

(B) for each such recommendation, wheth-

(c) ADMINISTRATIVE AND TECHNICAL SUPPORT.—

The Secretary shall provide such administrative support,
5
staff, and technical assistance to the Council as the Sec-
6
retary determines to be necessary for the Council to carry
7
out its duties.

SEC. 4. DEFINITIONS.

In this Act, the following definitions apply:
10
(1) COUNCIL REPORT.—The term ‘‘Council re-
11
port’’ means the report described in section 2(b)(2).

(2) SECRETARY.—The term ‘‘Secretary’’ means
13
the Secretary of Transportation.
