ADVANCED DRUNK DRIVING PREVENTION TECH- 1 NOLOGY. 2 (a) REQUIREMENTS.— 3 (1) MOTOR VEHICLE SAFETY STANDARD.—Not 4 later than 18 months after the date of enactment of 5 this Act, the Secretary of Transportation shall issue 6 an advanced notice of proposed rulemaking to ini- 7 tiate a rulemaking to prescribe a motor vehicle safe- 8 ty standard under section 30111 of title 49, United 9 States Code, that requires passenger motor vehicles 10 manufactured after the effective date of such stand- 11 ard to be equipped with advanced drunk driving pre- 12 vention technology. 13 (2) NOTICE AND COMMENT.—Not later than 3 14 years after the date of enactment of this Act, the 15 Secretary of Transportation shall issue a notice of 16 proposed rulemaking in order to continue the rule- 17 making proceeding required by paragraph (1). 18 (3) FINAL RULE.— 19 (A) Not later than 5 years after the date 20 of enactment of this Act, the Secretary shall 21 prescribe a final rule containing the motor vehi- 22 cle safety standard required under this sub- 23 section. The final rule shall specify an effective 24 date that provides at least 2 years, and no more 25 VerDate Sep 11 2014 01:04 May 20, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2138.IH H2138 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 2138 IH than 3 years, to allow for manufacturing com- 1 pliance. 2 (B) If the Secretary determines that a new 3 motor vehicle safety standard required under 4 this subsection cannot meet the requirements 5 and considerations set forth in subsections (a) 6 and (b) of section 30111 of title 49, United 7 States Code, the Secretary shall submit a re- 8 port to the Committee on Energy and Com- 9 merce of the House of Representatives and the 10 Committee on Commerce, Science and Trans- 11 portation of the Senate describing the reasons 12 for not prescribing such a standard. 13 (b) DEVELOPMENT.—The Secretary shall work di- 14 rectly with manufacturers of passenger motor vehicles, 15 suppliers, safety advocates, and other interested parties, 16 including universities with expertise in automotive engi- 17 neering, to— 18 (1) accelerate the development of the advanced 19 drunk driving prevention technology required to pre- 20 scribe a motor vehicle safety standard described in 21 subsection (a); and 22 (2) ensure the integration of such technology 23 into passenger motor vehicles available for sale at 24 the earliest practicable date. 25 VerDate Sep 11 2014 01:04 May 20, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2138.IH H2138 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 2138 IH (c) DEFINITIONS.—In this section— 1 (1) the term ‘‘advanced drunk driving preven- 2 tion technology’’ means a passive system which— 3 (A) monitors a driver’s performance to 4 identify impairment of a driver; 5 (B) a system which passively detects a 6 blood alcohol level equal to and exceeding .08 7 blood alcohol content; or 8 (C) a similar system which detects impair- 9 ment and prevents or limits vehicle operation; 10 (2) the term ‘‘motor vehicle safety standard’’ 11 has the meaning given such term in section 30102 12 of title 49, United States Code; and 13 (3) the term ‘‘passenger motor vehicle’’ has the 14 meaning given such term in section 32101 of title 15 49, United States Code. 16 Æ VerDate Sep 11 2014 01:04 May 20, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2138.IH H2138 kjohnson on DSK79L0C42PROD with BILLS
