Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Rural Health Clinic 4 Protection Act’’. 5 SEC. 2. RURAL HEALTH CLINIC PAYMENTS. 6 (a) IN GENERAL.—Section 1833(f)(3) of the Social 7 Security Act (42 U.S.C. 1395l(f)(3)) is amended— 8 (1) in subparagraph (A)— 9 VerDate Sep 11 2014 04:42 Apr 14, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S935.IS S935 pbinns on DSKJLVW7X2PROD with BILLS 2 •S 935 IS (A) in clause (i), by striking subclauses (I) 1 and (II) and inserting the following: 2 ‘‘(I) with respect to a rural 3 health clinic that had a per visit pay- 4 ment amount established for services 5 furnished in 2020— 6 ‘‘(aa) the per visit payment 7 amount applicable to such rural 8 health clinic for rural health clin- 9 ic services furnished in 2020, in- 10 creased by the percentage in- 11 crease in the MEI applicable to 12 primary care services furnished 13 as of the first day of 2021; or 14 ‘‘(bb) the limit described in 15 paragraph (2)(A); and 16 ‘‘(II) with respect to a rural 17 health clinic that did not have a per 18 visit payment amount established for 19 services furnished in 2020— 20 ‘‘(aa) the per visit payment 21 amount applicable to such rural 22 health clinic for rural health clin- 23 ic services furnished in 2021; or 24 VerDate Sep 11 2014 04:42 Apr 14, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S935.IS S935 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 935 IS ‘‘(bb) the limit described in 1 paragraph (2)(A); and’’; and 2 (B) in clause (ii)(I), by striking ‘‘under 3 clause (i)(I)’’ and inserting ‘‘under subclause 4 (I) or (II) of clause (i), as applicable,’’; and 5 (2) by striking subparagraph (B) and inserting 6 the following: 7 ‘‘(B) A rural health clinic described in this subpara- 8 graph is a rural health clinic that— 9 ‘‘(i) as of December 31, 2020, was in a hospital 10 with less than 50 beds and after such date such hos- 11 pital continues to have less than 50 beds (not taking 12 into account any increase in the number of beds pur- 13 suant to a waiver under subsection (b)(1)(A) of sec- 14 tion 1135 during the emergency period described in 15 subsection (g)(1)(B) of such section); and 16 ‘‘(ii)(I) as of December 31, 2020, was enrolled 17 under section 1866(j) (including temporary enroll- 18 ment during such emergency period for such emer- 19 gency period); or 20 ‘‘(II) submitted an application for enrollment 21 under section 1866(j) (or a request for such a tem- 22 porary enrollment for such emergency period) that 23 was received not later than December 31, 2020.’’. 24 VerDate Sep 11 2014 04:42 Apr 14, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S935.IS S935 pbinns on DSKJLVW7X2PROD with BILLS 4 •S 935 IS (b) EFFECTIVE DATE.—The amendments made by 1 this section shall take effect as if included in the enact- 2 ment of the Consolidated Appropriations Act, 2021 (Pub- 3 lic Law 116–260). 4 Æ VerDate Sep 11 2014 04:42 Apr 14, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S935.IS S935 pbinns on DSKJLVW7X2PROD with BILLS
