PASSIVE CAPABILITY TO IDENTIFY LOST AND STO- 1 LEN FIREARMS. 2 (a) ESTABLISHMENT OF NATIONAL STANDARD.— 3 (1) IN GENERAL.—The Attorney General shall, 4 in consultation with the National Institute for 5 Standards and Technology, establish in regulations a 6 national standard for the incorporation of a passive 7 identification capability into all firearms sold in the 8 United States. 9 (2) PASSIVE IDENTIFICATION CAPABILITY DE- 10 FINED.—In this section, the term ‘‘passive identi- 11 fication capability’’ means a technology that— 12 (A) enables a firearm to be identified by a 13 mobile or fixed reading device; and 14 (B) does not emit or broadcast an elec- 15 tronic signal or other information that would 16 enable the firearm or its owner to be monitored 17 or tracked. 18 (3) CONSIDERATIONS.—In developing the 19 standard, the Attorney General shall give equal pri- 20 ority to the following: 21 (A) The right of firearm owners to main- 22 tain their full right to privacy under the 4th 23 Amendment and their right to legally own fire- 24 arms under the 2nd Amendment. 25 VerDate Sep 11 2014 05:02 May 12, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1952.IH H1952 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 1952 IH (B) The ability of law enforcement authori- 1 ties to use the capability to track lost and sto- 2 len guns. 3 (C) The ability of manufacturers to incor- 4 porate the capability using existing firearm 5 manufacturing processes. 6 (D) The resistance to tampering and de- 7 struction of the technology used to incorporate 8 the capability. 9 (b) PROHIBITION; PENALTY.— 10 (1) PROHIBITION.—It shall be unlawful for a 11 person, in or affecting interstate or foreign com- 12 merce, to manufacture a firearm that does not have 13 a passive identification capability that meets the na- 14 tional standard established under subsection (a). 15 (2) CIVIL PENALTY.—After notice and oppor- 16 tunity for hearing, the Attorney General shall im- 17 pose on a person who violates paragraph (1) a civil 18 money penalty in such amount, not exceeding 19 $2,500 per firearm, as the Attorney General shall 20 prescribe in regulations. 21 (3) EFFECTIVE DATE.—This subsection shall 22 take effect on such date as the Attorney General 23 shall prescribe in regulations that is not later than 24 VerDate Sep 11 2014 05:02 May 12, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1952.IH H1952 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 1952 IH 3 years after the establishment of the national 1 standard under subsection (a). 2 SEC. 3. REPORTING OF LOST OR STOLEN FIREARMS TO 3 LOCAL LAW ENFORCEMENT AUTHORITIES. 4 (a) REPORTING REQUIREMENT.—Section 922 of title 5 18, United States Code, is amended by adding at the end 6 the following: 7 ‘‘(aa) Within 48 hours after a person who owns a 8 firearm that has been shipped or transported in, or has 9 been possessed in or affecting, interstate or foreign com- 10 merce, discovers or should have discovered the theft or loss 11 of the firearm, the person shall report the theft or loss 12 to local law enforcement authorities. To the best of the 13 person’s ability, the person shall provide the following in- 14 formation, if known: 15 ‘‘(1) A description of the firearm, including the 16 make, model, manufacturer, caliber, and serial num- 17 ber of the firearm, and any other distinguishing 18 number or identification mark on the firearm. 19 ‘‘(2) Whether the firearm is being reported lost 20 or stolen. 21 ‘‘(3) The date of the loss or theft. 22 ‘‘(4) The person’s name and address. 23 ‘‘(5) The location from which the firearm was 24 lost or stolen.’’. 25 VerDate Sep 11 2014 05:02 May 12, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1952.IH H1952 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 1952 IH (b) PENALTIES.—Section 924 of such title is amend- 1 ed by adding at the end the following: 2 ‘‘(q) PENALTIES FOR FAILURE TO REPORT LOSS OR 3 THEFT OF FIREARM.—Whoever violates section 922(aa) 4 shall be fined $10,000, imprisoned not more than 1 year, 5 or both, with respect to each firearm involved in the viola- 6 tion.’’. 7 (c) REQUIREMENT THAT LOCAL LAW ENFORCE- 8 MENT AUTHORITIES REPORT LOST OR STOLEN FIRE- 9 ARMS TO THE NATIONAL CRIME INFORMATION CEN- 10 TER.—Within 7 days after a local law enforcement author- 11 ity receives a report that a firearm is lost or stolen, the 12 authority shall transmit the report to the National Crime 13 Information Center maintained by the Federal Bureau of 14 Investigation. 15 Æ VerDate Sep 11 2014 05:02 May 12, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H1952.IH H1952 kjohnson on DSK79L0C42PROD with BILLS
