Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. GENDER REASSIGNMENT MEDICAL INTERVENTIONS 1 ON MINORS PROHIBITED. 2 Chapter 110 of title 18, United States Code, is 3 amended— 4 (1) by adding at the end the following: 5 ‘‘§ 2260B. Gender reassignment medical interventions 6 on minors 7 ‘‘(a) IN GENERAL.—Whoever knowingly performs 8 any gender reassignment medical intervention on a minor 9 shall be fined under this title or imprisoned not more than 10 5 years, or both. 11 ‘‘(b) PROHIBITION ON PROSECUTION OF PERSON ON 12 WHOM INTERVENTION IS PERFORMED.—No person on 13 whom the gender reassignment medical intervention under 14 subsection (a) is performed may be arrested or prosecuted 15 for an offense under this section. 16 ‘‘(c) CIVIL ACTION.—A person on whom a gender re- 17 assignment medical intervention is performed under this 18 section may bring a civil action for appropriate relief 19 against each person who performed the gender reassign- 20 ment medical intervention. 21 ‘‘(d) DEFINITIONS.—In this section: 22 ‘‘(1) GENDER REASSIGNMENT MEDICAL INTER- 23 VENTION.— 24 ‘‘(A) IN GENERAL.—For purposes of this 25 chapter, except as provided in subparagraph 26 VerDate Sep 11 2014 23:29 May 11, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1926.IH H1926 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 1926 IH (B), the term ‘gender reassignment medical 1 intervention’ means— 2 ‘‘(i) performing a surgery that steri- 3 lizes an individual, including castration, 4 vasectomy, hysterectomy, oophorectomy, 5 metoidioplasty, penectomy, phalloplasty, 6 and vaginoplasty, to change the body of 7 such individual to correspond to a sex that 8 is discordant with biological sex; 9 ‘‘(ii) performing a mastectomy on an 10 individual for the purpose described in 11 clause (i); or 12 ‘‘(iii) administering or supplying to an 13 individual medications for the purpose de- 14 scribed in clause (i), including— 15 ‘‘(I) GnRH agonists or other pu- 16 berty-blocking drugs to stop or delay 17 normal puberty; 18 ‘‘(II) testosterone or other andro- 19 gens to biological females at doses 20 that are supraphysiologic to the fe- 21 male sex; or 22 ‘‘(III) estrogen to biological 23 males at doses that are supraphysio- 24 logic to the male sex. 25 VerDate Sep 11 2014 23:29 May 11, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1926.IH H1926 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 1926 IH ‘‘(B) EXCEPTION.—Subparagraph (A) 1 shall not apply to the following individuals: 2 ‘‘(i) An individual with external bio- 3 logical sex characteristics that are 4 irresolvably ambiguous, such as those born 5 with 46 XX chromosomes with virilization, 6 46 XY chromosomes with undervirilization, 7 or having both ovarian and testicular tis- 8 sue. 9 ‘‘(ii) An individual with respect to 10 whom a physician has determined through 11 genetic or biochemical testing that the in- 12 dividual does not have normal sex chro- 13 mosome structure, sex steroid hormone 14 production, or sex steroid hormone action 15 for a biological male or biological female. 16 ‘‘(2) MINOR.—The term ‘minor’ means any per- 17 son under the age of eighteen years.’’; and 18 (2) by amending the table of sections for such 19 chapter by adding at the end the following: 20 ‘‘2260B.
