Mr. CHABOT (for himself and Mr. LATTA) introduced the following bill; which
was referred to the Committee on Energy and Commerce, and in addition
to the Committee on the Judiciary, for a period to be subsequently deter-
mined by the Speaker, in each case for consideration of such provisions
as fall within the jurisdiction of the committee concerned
A BILL
To amend the Controlled Substances Act to list fentanyl-
related substances as schedule I controlled substances.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Federal Initiative To
4
Guarantee Health by Targeting Fentanyl Act’’.
5
SEC. 2. FENTANYL-RELATED SUBSTANCES.

Schedule I of section 202(c) of the Controlled Sub-
7
stances Act (21 U.S.C. 812(c)) is amended by adding at
8
the end the following:

‘‘(e)(1) Unless specifically exempted or unless listed

in another schedule, any material, compound, mixture, or
2
preparation which contains any quantity of fentanyl-re-
3
lated substances, or which contains their salts, isomers,
4
and salts of isomers whenever the existence of such salts,
5
isomers, and salts of isomers is possible within the specific
6
chemical designation.

‘‘(2) In paragraph (1), the term ‘fentanyl-related sub-
8
stances’ includes any substance that is structurally related
9
to fentanyl by 1 or more of the following modifications:
10
‘‘(A) By replacement of the phenyl portion of
11
the phenethyl group by any monocycle, whether or
12
not further substituted in or on the monocycle.

‘‘(B) By substitution in or on the phenethyl
14
group with alkyl, alkenyl, alkoxyl, hydroxyl, halo,
15
haloalkyl, amino, or nitro groups.

‘‘(C) By substitution in or on the piperidine
17
ring with alkyl, alkenyl, alkoxyl, ester, ether, hydrox-
18
yl, halo, haloalkyl, amino, or nitro groups.
19
‘‘(D) By replacement of the aniline ring with
20
any aromatic monocycle whether or not further sub-
21
stituted in or on the aromatic monocycle.
22
‘‘(E) By replacement of the N-propionyl group
23
by another acyl group.’’.
