To extend Federal recognition to the Pee Dee Indian Tribe
of McColl, South Carolina.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Pee Dee Indian Ac-
4
knowledgement Act’’.

SEC. 2. FEDERAL RECOGNITION.

(a) FEDERAL RECOGNITION.—Federal recognition is
7
extended to the Pee Dee Indian Tribe of McColl, South
8
Carolina.

(b) APPLICABILITY OF LAWS.—All laws (including
1
regulations) of the United States of general applicability
2
to Indians or Nations, Indian Tribes, or bands of Indians
3
(including the Act of June 18, 1934 (25 U.S.C. 461 et
4
seq.)) shall be applicable to the Pee Dee Indian Tribe of
5
McColl, South Carolina, and members of that Tribe.

SEC. 3. FEDERAL SERVICES AND BENEFITS.

(a) IN GENERAL.—Beginning on the date of the en-
8
actment of this Act, the Tribe and each member shall be
9
eligible for all services and benefits provided by the United
10
States to Indians and federally recognized Indian tribes,
11
without regard to—
12
(1) the existence of a reservation for the Tribe;
13
or
14
(2) the location of the residence of any member
15
on or near an Indian reservation.
16
(b) SERVICE AREA.—For purposes of the delivery of
17
services and benefits to members, the service area of the
18
Tribe shall be considered to be the area comprised of Marl-
19
boro County in the State of South Carolina.

SEC. 4. MEMBERSHIP ROLL.

(a) IN GENERAL.—As a condition of receiving rec-
22
ognition, services, and benefits pursuant to this Act, the
23
Tribe shall submit to the Secretary, by not later than 18
24
months after the date of the enactment of this Act, a

membership roll consisting of the name of each individual
1
enrolled as a member of the Tribe.

(b) DETERMINATION OF MEMBERSHIP.—The quali-
3
fications for inclusion on the membership roll of the Tribe
4
shall be determined in accordance with sections 1 through
5
5 of article III of the proposed constitution of the Tribe
6
dated December 2020 (including amendments to the con-
7
stitution).

(c) MAINTENANCE OF ROLL.—The Tribe shall main-
9
tain the membership roll under this section.

SEC. 5. DEFINITIONS.

For the purposes of this Act:

(1) MEMBER.—The term ‘‘member’’ means an
13
individual duly enrolled in the roll of the Tribe de-
14
scribed in section 4.
15
(2) SECRETARY.—The term ‘‘Secretary’’ means
16
the Secretary of the Interior.
17
(3) TRIBE.—The term ‘‘Tribe’’ means the Pee
18
Dee Indian Tribe of McColl, South Carolina.
