A BILL
To temporarily modify the application of the sequester under
the Statutory Pay-As-You-Go Act of 2010, and for other
purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Responsible and Effec-
4
tive Spending Cuts of Undesirable Expenditures Act’’ or
5
the ‘‘RESCUE Act’’.
6
SEC. 2. APPLICATION OF PAYGO ACT SEQUESTRATION.

(a) APPLICATION.—

(1) IN GENERAL.—Notwithstanding any other
1
provision of law, with respect to carrying out the
2
first sequestration order under the Statutory Pay-
3
As-You-Go Act of 2010 issued after the date of en-
4
actment of this Act, before any other direct spending
5
program (including Medicare programs described in
6
section 256(d) of the Balanced Budget and Emer-
7
gency Deficit Control Act of 1985) is reduced under
8
such order, the budgetary resources of the direct
9
spending programs described in subsection (b)—
10
(A) shall be reduced, in the order such
11
provisions are listed in such subsection, in an
12
amount equal to the amount of any reduction
13
required, but for this section, for Medicare pro-
14
grams under section 6 of the Statutory Pay-As-
15
You-Go Act of 2010; and
16
(B) after the reduction required under sub-
17
paragraph (A), shall be further reduced, in the
18
order such provisions are listed in such sub-
19
section, by the amount (if any) of the remaining
20
budget-year debit as determined under such
21
section 6.

(2) REGULAR
PROCEDURE.—After the reduc-
23
tions required by paragraph (1), such sequestration
24
order shall be carried out with respect to direct

spending programs (excluding such Medicare pro-
1
grams) consistent with the requirements of the Stat-
2
utory Pay-As-You-Go Act of 2010.

(b) WASTEFUL SPENDING PROGRAMS.—The direct
4
spending programs described in this subsection are as fol-
5
lows:
6
(1) Section 9704 of the American Rescue Plan
7
Act of 2021 (Public Law 117–2) and the amend-
8
ments made by such section (relating to special fi-
9
nancial assistance program for financially troubled
10
multiemployer plans).
11
(2) Section 9901 of such Act and the amend-
12
ments made by such section (relating to coronavirus
13
State and local fiscal recovery funds).
14
(3) Title X of such Act (relating to foreign rela-
15
tions).
16
(4) Any other provision of such Act or any
17
amendment made by such provision (if applicable)
18
that is not related to the direct health care treat-
19
ment and prevention of COVID–19 in the United
20
States.
