A BILL
To require executive agencies to reduce cost-sharing require-
ments for certain grants with certain nonprofit organiza-
tions, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Empowering Non-
4
profits Act’’.
5
SEC. 2. REMOVAL AND REDUCTION OF COST-SHARING RE-
6
QUIREMENTS FOR GRANTS.

(a) REMOVAL
OF
COST-SHARING
REQUIREMENT

DURING
THE COVID–19 EMERGENCY PERIOD.—Any

cost-sharing requirement for an eligible nonprofit organi-

zation for grants made directly to that organization by an
2
executive agency shall be waived during a COVID–19
3
emergency period.

(b)
REDUCTION
OF
COST-SHARING
REQUIRE-
5
MENT.—Beginning on the expiration of the COVID–19
6
emergency period and ending 5 years thereafter, the head
7
of an executive agency shall reduce any cost-sharing re-
8
quirement 25 percent for an eligible nonprofit organiza-
9
tion for grants made directly to that organization.

(c) DEFINITIONS.—In this section:
11
(1) COVID–19
EMERGENCY
PERIOD.—The
12
term ‘‘COVID–19 emergency period’’ means a pe-
13
riod that—
14
(A) begins on the date of a determination
15
by the Secretary of Health and Human Services
16
pursuant to section 319 of the Public Health
17
Service Act (42 U.S.C. 247d) that a public
18
health emergency exists as a result of COVID–
19
19; and
20
(B) ends on the date on which such deter-
21
mination (including any renewal thereof) termi-
22
nates.

(2) ELIGIBLE NONPROFIT ORGANIZATION.—The
24
term ‘‘eligible nonprofit organization’’ means a non-

profit organization that is located in a State with
1
more than 20 percent of individuals living below the
2
Federal poverty line.

(3) EXECUTIVE AGENCY.—The term ‘‘executive
4
agency’’ has the meaning given in section 133 of
5
title 41, United States Code.

(4) NONPROFIT
ORGANIZATION.—The term
7
‘‘nonprofit organization’’ means an organization that
8
is described in section 501(c)(3) of the Internal Rev-
9
enue Code of 1968 and exempt from taxation under
10
section 501(a) of such Code.

(5) STATE.—The term ‘‘State’’ means each of
12
the several States, the District of Columbia, each
13
commonwealth, territory, or possession of the United
14
States, and each federally recognized Tribe.
