To amend title 5, United States Code, to provide for the temporary halt
in pension payments for Members of Congress sentenced for certain
offenses, and for other purposes.

Ms. TENNEY introduced the following bill; which was referred to the Com-
mittee on House Administration, and in addition to the Committee on
Oversight and Reform, for a period to be subsequently determined by the
Speaker, in each case for consideration of such provisions as fall within
the jurisdiction of the committee concerned
A BILL
To amend title 5, United States Code, to provide for the
temporary halt in pension payments for Members of Con-
gress sentenced for certain offenses, and for other pur-
poses.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββNo Pensions for Cor-
4
rupt Politicians Act of 2021ββ.

SEC. 2. FORFEITURE OF PENSION.

(a) CSRS.βSection 8332(o) of title 5, United States
2
Code, is amended by adding at the end the following:
3
ββ(7)(A) Subject to subparagraph (B), an individual
4
convicted of an offense described in paragraph (2) shall
5
not, between the date of sentencing and the date of final
6
conviction for such offense, be eligible to receive any pay-
7
ment of an annuity pursuant to the retirement system
8
under this subchapter, except that this sentence applies
9
only to such payments based on service rendered as a
10
Member (irrespective of when rendered).

ββ(B) If the conviction of an individual described in
12
subparagraph (A) is held to be invalid, such individual
13
shall receive payments that such individual would have re-
14
ceived but for application of subparagraph (A).

ββ(C) The provisions of this paragraph only apply to
16
a conviction that occurs after the date of enactment of
17
this paragraph.ββ.

(b) FERS.βSection 8411(l) of title 5, United States
19
Code, is amended by adding at the end the following:

ββ(7)(A) Subject to subparagraph (B), an indi-
21
vidual convicted of an offense described in para-
22
graph (2) shall not, between the date of sentencing
23
and the date of final conviction for such offense, be
24
eligible to receive any payment of an annuity pursu-
25
ant to the retirement system under this chapter, ex-
