A BILL
To amend the Higher Education Act of 1965 to clarify
the treatment of certain institutional financial assistance.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Keep College Students
4
Learning Act’’.
5
SEC. 2. TREATMENT OF CERTAIN INSTITUTIONAL FINAN-
6
CIAL ASSISTANCE.

Part C of title I of the Higher Education Act of 1965
8
(20 U.S.C. 1015 et seq.) is amended by adding at the end
9
the following:

‘‘SEC. 138. TREATMENT OF CERTAIN INSTITUTIONAL FINAN-

CIAL ASSISTANCE.

‘‘(a) IN GENERAL.—A covered institution of higher
3
education shall ensure that a student who has received in-
4
stitutional financial assistance from such institution may
5
use such assistance for enrollment at such institution
6
without regard to whether, during the COVID-19 pan-
7
demic, the student delays such enrollment or takes a leave
8
of absence from such institution for up to one academic
9
year.

‘‘(b) DEFINITIONS.—In this section:
11
‘‘(1) COVERED INSTITUTION OF HIGHER EDU-
12
CATION.—The term ‘covered institution of higher
13
education’ means an institution of higher education
14
(as defined in section 102) that—
15
‘‘(A) receives funds under this Act; and
16
‘‘(B) offers in-person instruction at levels
17
less than the first semester (or the equivalent)
18
of academic year 2019–2020.
19
‘‘(2) STUDENT.—The term ‘student’ includes a
20
prospective student.’’.
