Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. RURAL HEALTH CLINIC PAYMENTS. 1 (a) IN GENERAL.—Section 1833(f)(3) of the Social 2 Security Act (42 U.S.C. 1395l(f)(3)) is amended— 3 (1) in subparagraph (A)— 4 (A) in clause (i), by striking subclauses (I) 5 and (II) and inserting the following: 6 ‘‘(I) with respect to a rural health 7 clinic that had a per visit payment amount 8 established for services furnished in 9 2020— 10 ‘‘(aa) the per visit payment 11 amount applicable to such rural 12 health clinic for rural health clinic 13 services furnished in 2020, increased 14 by the percentage increase in the MEI 15 applicable to primary care services 16 furnished as of the first day of 2021; 17 or 18 ‘‘(bb) the limit described in para- 19 graph (2)(A); and 20 ‘‘(II) with respect to a rural health 21 clinic that did not have a per visit payment 22 amount established for services furnished 23 in 2020— 24 ‘‘(aa) the per visit payment 25 amount applicable to such rural 26 VerDate Sep 11 2014 23:03 May 12, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1885.IH H1885 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 1885 IH health clinic for rural health clinic 1 services furnished in 2021; or 2 ‘‘(bb) the limit described in para- 3 graph (2)(A); and’’; and 4 (B) in clause (ii)(I), by striking ‘‘under 5 clause (i)(I)’’ and inserting ‘‘under subclause 6 (I) or (II) of clause (i), as applicable,’’; and 7 (2) in subparagraph (B)— 8 (A) in the matter preceding clause (i), by 9 striking ‘‘2019, was’’ and inserting ‘‘2020’’; 10 (B) in clause (i), by inserting ‘‘was’’ after 11 ‘‘(i)’’; and 12 (C) by striking clause (ii) and inserting the 13 following: 14 ‘‘(ii)(I) was enrolled under section 1866(j) 15 (including temporary enrollment during the 16 emergency period described in section 17 1135(g)(1)(B) for such period); or 18 ‘‘(II) submitted an application for enroll- 19 ment under section 1866(j) (or requested such 20 a temporary enrollment for such period) that 21 was received not later than December 31, 22 2020.’’. 23 (b) EFFECTIVE DATE.—The amendments made by 24 this section shall take effect as if included in the enact- 25 VerDate Sep 11 2014 23:03 May 12, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1885.IH H1885 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 1885 IH ment of the Consolidated Appropriations Act, 2021 (Pub- 1 lic Law 116–260). 2 Æ VerDate Sep 11 2014 23:03 May 12, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H1885.IH H1885 pamtmann on DSKBC07HB2PROD with BILLS
