Mr. KIND (for himself, Mr. LAHOOD, Ms. SCHRIER, Mr. GRIFFITH, Mr.
COSTA, and Mrs. WALORSKI) introduced the following bill; which was re-
ferred to the Committee on Energy and Commerce, and in addition to
the Committee on Ways and Means, for a period to be subsequently de-
termined by the Speaker, in each case for consideration of such provisions
as fall within the jurisdiction of the committee concerned
A BILL
To amend title XVIII of the Social Security Act to adjust
certain rural health clinic payments under the Medicare
program.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ββRural and Underserved
4
Small Hospital Protection Act of 2021ββ or the ββRUSH
5
Protection Act of 2021ββ.

SEC. 2. RURAL HEALTH CLINIC PAYMENTS.

(a) IN GENERAL.βSection 1833(f)(3) of the Social
2
Security Act (42 U.S.C. 1395l(f)(3)) is amendedβ
3
(1) in subparagraph (A)β
4
(A) in clause (i), by striking subclauses (I)
5
and (II) and inserting the following:
6
ββ(I) with respect to a rural health
7
clinic that had a per visit payment amount
8
established
for
services
furnished
in
9
2020β
10
ββ(aa) the per visit payment
11
amount applicable to such rural
12
health clinic for rural health clinic
13
services furnished in 2020, increased
14
by the percentage increase in the MEI
15
applicable to primary care services
16
furnished as of the first day of 2021;
17
or
18
ββ(bb) the limit described in para-
19
graph (2)(A); and
20
ββ(II) with respect to a rural health
21
clinic that did not have a per visit payment
22
amount established for services furnished
23
in 2020β
24
ββ(aa) the per visit payment
25
amount applicable to such rural

(A) in the matter preceding clause (i), by

(C) by striking clause (ii) and inserting the

following:

ββ(ii)(I) was enrolled under section 1866(j)

(including temporary enrollment during the

emergency
period
described
in
section

1135(g)(1)(B) for such period); or
18
ββ(II) submitted an application for enroll-
19
ment under section 1866(j) (or requested such
20
a temporary enrollment for such period) that
21
was received not later than December 31,
22
2020.ββ.

(b) EFFECTIVE DATE.βThe amendments made by
24
this section shall take effect as if included in the enact-
