Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Impact Aid Infrastruc- 4 ture Act’’. 5 SEC. 2. IMPACT AID CONSTRUCTION GRANTS AUTHORIZED. 6 (a) FUNDING AND SUNSET.— 7 (1) AUTHORIZATION OF APPROPRIATIONS.— 8 There are authorized to be appropriated 9 VerDate Sep 11 2014 23:04 May 12, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1886.IH H1886 pamtmann on DSKBC07HB2PROD with BILLS 2 •HR 1886 IH $1,000,000,000 for fiscal year 2022 to carry out 1 this Act. 2 (2) SUPPLEMENTAL FUNDING.—The amount 3 authorized under paragraph (1) shall be in addition 4 to any amounts authorized to be appropriated or 5 otherwise made available to carry out section 7007 6 of the Elementary and Secondary Education Act of 7 1965 (20 U.S.C. 7707). 8 (3) AVAILABILITY OF FUNDS.—Any amounts 9 appropriated under paragraph (1) shall remain 10 available until expended. 11 (4) SUNSET.—The authority to award grants 12 under this Act shall expire at the end of the 3-year 13 period beginning on the date on which funds are 14 first made available to award a grant under this Act. 15 (b) RESERVATION FOR MANAGEMENT AND OVER- 16 SIGHT.—From the funds appropriated under subsection 17 (a)(1), the Secretary of Education may reserve not more 18 than half of 1 percent for management and oversight of 19 the activities carried out with those funds. 20 (c) FORMULA GRANTS.— 21 (1) IN GENERAL.—From 40 percent of the 22 funds appropriated under subsection (a)(1) and not 23 reserved under subsection (b), the Secretary of Edu- 24 cation shall make payments in accordance with sec- 25 VerDate Sep 11 2014 23:04 May 12, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1886.IH H1886 pamtmann on DSKBC07HB2PROD with BILLS 3 •HR 1886 IH tion 7007(a) of the Elementary and Secondary Edu- 1 cation Act of 1965 (20 U.S.C. 7707(a)). 2 (2) SPECIAL RULE.—The Secretary of Edu- 3 cation when calculating the total number of weighted 4 student units as described in paragraph (3)(A)(i)(II) 5 of section 7007(a) of the Elementary and Secondary 6 Education Act of 1965 (20 U.S.C. 7707(a)) shall in- 7 clude the total number of weighted student units of 8 children described in subparagraphs (B) and (D)(i) 9 of section 7003(a)(1) of such Act for all local edu- 10 cational agencies not meeting the requirements as 11 described in section 7007(a)(2)(B) of such Act but 12 that meet the requirements of section 572(a)(2) of 13 the National Defense Authorization Act for Fiscal 14 Year 2006 (20 U.S.C. 7703b). 15 (d) COMPETITIVE GRANTS.—From 60 percent of the 16 funds appropriated under subsection (a)(1) and not re- 17 served under subsection (b), the Secretary of Education— 18 (1) shall award emergency grants in accordance 19 with section 7007(b) of the Elementary and Sec- 20 ondary Education Act of 1965 (20 U.S.C. 7707(b)), 21 except as otherwise provided in this Act; and 22 (2) may award modernization grants in accord- 23 ance with section 7007(b) of the Elementary and 24 VerDate Sep 11 2014 23:04 May 12, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1886.IH H1886 pamtmann on DSKBC07HB2PROD with BILLS 4 •HR 1886 IH Secondary Education Act of 1965 (20 U.S.C. 1 7707(b)), except as otherwise provided in this Act. 2 SEC. 3. ELIGIBILITY. 3 (a) ELIGIBILITY FOR EMERGENCY GRANTS.— 4 (1) IN GENERAL.—For purposes of receiving an 5 emergency grant under section 2(d)(1), in addition 6 to a local educational agency that meets the eligi- 7 bility requirements for the award of such a grant 8 under any of subparagraph (A), (C), or (D) of sec- 9 tion 7007(b)(3) of the Elementary and Secondary 10 Education Act of 1965 (20 U.S.C. 7707(b)(3)), a 11 local educational agency that meets the requirements 12 described in paragraph (2) (without regard to 13 whether the agency meets any of the requirements 14 of such subparagraph (A), (C), or (D)), shall be eli- 15 gible for such a grant. 16 (2) REQUIREMENTS.—A local educational agen- 17 cy meets the requirements of this paragraph, if such 18 agency has— 19 (A) a total taxable assessed value of real 20 property that may be taxed for school purposes 21 of less than $100,000,000; or 22 (B) an assessed value of real property per 23 student that may be taxed for school purposes 24 that is less than the average of the assessed 25 VerDate Sep 11 2014 23:04 May 12, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1886.IH H1886 pamtmann on DSKBC07HB2PROD with BILLS 5 •HR 1886 IH value of real property per student that may be 1 taxed for school purposes in the State in which 2 the local educational agency is located. 3 (b) ELIGIBILITY FOR MODERNIZATION GRANTS.— 4 (1) IN GENERAL.—For purposes of receiving a 5 modernization grant under section 2(d)(2), in addi- 6 tion to a local educational agency that meets the eli- 7 gibility requirements for the award of such a grant 8 under any of subparagraph (B), (C), or (D) of sec- 9 tion 7007(b)(3) of the Elementary and Secondary 10 Education Act of 1965 (20 U.S.C. 7707(b)(3)), a 11 local educational agency that meets the requirements 12 described in paragraph (2) (without regard to 13 whether the agency meets any of the requirements 14 of such subparagraph (B), (C), or (D)), shall be eli- 15 gible for such a grant. 16 (2) REQUIREMENTS.—A local educational agen- 17 cy meets the requirements of this paragraph, if such 18 agency has— 19 (A) a total taxable assessed value of real 20 property that may be taxed for school purposes 21 of less than $100,000,000; or 22 (B) an assessed value of real property per 23 student that may be taxed for school purposes 24 that is less than the average of the assessed 25 VerDate Sep 11 2014 23:04 May 12, 2021 Jkt 019200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H1886.IH H1886 pamtmann on DSKBC07HB2PROD with BILLS 6 •HR 1886 IH value of real property per student that may be 1 taxed for school purposes in the State in which 2 the local educational agency is located. 3 (c) LOCAL EDUCATIONAL AGENCY DEFINED.—In 4 this section, the term ‘‘local educational agency’’ has the 5 meaning given the term in section 7013 of the Elementary 6 and Secondary Education Act of 1965 (20 U.S.C. 7713). 7 SEC. 4.
