A BILL
To amend the Richard B. Russell National School Lunch
Act to allow schools that participate in the school lunch
program under such Act to serve whole milk.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Whole Milk for
4
Healthy Kids Act of 2021’’.
5
SEC. 2. WHOLE MILK PERMISSIBLE.
6
Section 9(a)(2)(A) of the Richard B. Russell National
7
School Lunch Act (42 U.S.C. 1758(a)(2)(A)) is amended
8
to read as follows:

‘‘(A) IN
GENERAL.—Lunches served by
1
schools participating in the school lunch pro-
2
gram under this chapter—
3
‘‘(i) shall offer students a variety of
4
fluid milk;
5
‘‘(ii) may offer students flavored and
6
unflavored whole, reduced-fat, low-fat and
7
fat-free fluid milk and lactose-free fluid
8
milk; and
9
‘‘(iii) shall provide a substitute for
10
fluid milk for students whose disability re-
11
stricts their diet, on receipt of a written
12
statement from a licensed physician that
13
identifies the disability that restricts the
14
student’s diet and that specifies the sub-
15
stitute for fluid milk.’’.
