was referred to the Committee on Energy and Commerce, and in addition
to the Committee on Science, Space, and Technology, for a period to be
subsequently determined by the Speaker, in each case for consideration
of such provisions as fall within the jurisdiction of the committee con-
cerned
A BILL
To amend title XVII of the Energy Policy Act of 2005
relating to the eligibility for loan guarantees for projects
relating to hydrogen production, delivery, infrastructure,
storage, fuel cells, and end uses, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Clean Energy Hydro-
4
gen Innovation Act’’.

(a) CATEGORIES.—Section 1703(b)(3) of the Energy
4
Policy Act of 2005 (42 U.S.C. 16513(b)(3)) is amended
5
to read as follows:
6
‘‘(3) Hydrogen production, delivery, infrastruc-
7
ture, storage, fuel cells, and end uses, including
8
transportation, industrial, stationary power, and res-
9
idential applications.’’.

(b) INCLUDED PROJECTS.—Section 1703 of the En-
11
ergy Policy Act of 2005 (42 U.S.C. 16513) is further
12
amended by adding at the end the following:

‘‘(g) HYDROGEN
PROJECTS.—The category of
14
projects described in subsection (b)(3) includes projects
15
involving practices or technologies relating to—
16
‘‘(1) the development of infrastructure to enable
17
the production and utilization of hydrogen, including
18
pipelines, storage, processing, and fueling;
19
‘‘(2) the production of hydrogen to enable resil-
20
iency of power generation from domestic sources, in-
21
cluding renewable, fossil, and nuclear energy re-
22
sources;
23
‘‘(3) innovative methods of hydrogen production
24
from domestic sources, including renewable, fossil,
25
and nuclear energy sources;

‘‘(4) hydrogen based energy storage;

‘‘(5) portable power and material handling
2
equipment for hydrogen, including fuel cells, storage,
3
and fueling infrastructure; and
4
‘‘(6) transportation applications for hydrogen,
5
including light and heavy duty vehicles, medium and
6
heavy duty trucks and buses, fuel cells, storage, and
7
fueling infrastructure.’’.

(c) REPORT.—Not later than 1 year after the date
9
of enactment of this Act, the Secretary of Energy shall
10
submit to the Committee on Energy and Commerce of the
11
House of Representatives a report describing—
12
(1) with respect to projects described in sub-
13
section (g) of section 1703 of the Energy Policy Act
14
of 2005 (as added by this section)—
15
(A) the status of each such project for
16
which a guarantee has been awarded under
17
such section 1703; and
18
(B) any recommendations relating to im-
19
plementation of title XVII of such Act with re-
20
spect to such projects;
21
(2) opportunities to increase domestic hydrogen
22
production and utilization, including a review of the
23
domestic manufacturing base and supply chain;
24
(3) statutory and regulatory barriers to—

(A) the expansion of hydrogen infrastruc-

ture; and
2
(B) the commercialization and deployment
3
of hydrogen technologies; and
4
(4) any recommendations to expand hydrogen
5
infrastructure and to advance hydrogen technologies.
