DEFINITIONS. 1 (a) IN GENERAL.—Section 921(a) of title 18, United 2 States Code, is amended— 3 (1) by inserting after paragraph (29) the fol- 4 lowing: 5 ‘‘(30) The term ‘semiautomatic pistol’ means any re- 6 peating pistol that— 7 ‘‘(A) utilizes a portion of the energy of a firing 8 cartridge to extract the fired cartridge case and 9 chamber the next round; and 10 ‘‘(B) requires a separate pull of the trigger to 11 fire each cartridge. 12 ‘‘(31) The term ‘semiautomatic shotgun’ means any 13 repeating shotgun that— 14 ‘‘(A) utilizes a portion of the energy of a firing 15 cartridge to extract the fired cartridge case and 16 chamber the next round; and 17 ‘‘(B) requires a separate pull of the trigger to 18 fire each cartridge.’’; and 19 (2) by adding at the end the following: 20 ‘‘(36) The term ‘semiautomatic assault weapon’ 21 means any of the following, regardless of country of manu- 22 facture or caliber of ammunition accepted: 23 ‘‘(A) A semiautomatic rifle that— 24 ‘‘(i) has the capacity to utilize a magazine 25 that is not a fixed magazine; and 26 VerDate Sep 11 2014 18:58 Apr 03, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S736.IS S736 pbinns on DSKJLVW7X2PROD with BILLS 3 •S 736 IS ‘‘(ii) does have any 1 of the following: 1 ‘‘(I) A pistol grip. 2 ‘‘(II) A forward grip. 3 ‘‘(III) A folding, telescoping, or de- 4 tachable stock, or is otherwise foldable or 5 adjustable in a manner that operates to re- 6 duce the length, size, or any other dimen- 7 sion, or otherwise enhances the 8 concealability, of the weapon. 9 ‘‘(IV) A grenade launcher. 10 ‘‘(V) A barrel shroud. 11 ‘‘(VI) A threaded barrel. 12 ‘‘(B) A semiautomatic rifle that has a fixed 13 magazine with the capacity to accept more than 10 14 rounds, except for an attached tubular device de- 15 signed to accept, and capable of operating only with, 16 .22 caliber rimfire ammunition. 17 ‘‘(C) Any part, combination of parts, compo- 18 nent, device, attachment, or accessory that is de- 19 signed or functions to accelerate the rate of fire of 20 a semiautomatic firearm but not convert the semi- 21 automatic firearm into a machinegun. 22 ‘‘(D) A semiautomatic pistol that— 23 ‘‘(i) has the capacity to utilize a magazine 24 that is not a fixed magazine; and 24 VerDate Sep 11 2014 18:58 Apr 03, 2021 Jkt 019200 PO 00000 Frm 00013 Fmt 6652 Sfmt 6201 E:\BILLS\S736.IS S736 pbinns on DSKJLVW7X2PROD with BILLS 14 •S 736 IS ‘‘(B) does not include an attached tubular de- 1 vice designed to accept, and capable of operating 2 only with, .22 caliber rimfire ammunition.’’. 3 (b) RELATED DEFINITIONS.—Section 921(a) of title 4 18, United States Code, as amended by this Act, is 5 amended by adding at the end the following: 6 ‘‘(38) The term ‘barrel shroud’— 7 ‘‘(A) means a shroud that is attached to, or 8 partially or completely encircles, the barrel of a fire- 9 arm so that the shroud protects the user of the fire- 10 arm from heat generated by the barrel;
