A BILL
To transfer administrative jurisdiction over certain Bureau
of Land Management land from the Secretary of the
Interior to the Secretary of Veterans Affairs for use
as a national cemetery, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Elko National Ceme-
4
tery Act’’.

SEC. 2. DEFINITIONS.

(1) FEDERAL LAND.—The term ‘‘Federal land’’

means the approximately 15 acres of Bureau of
2
Land Management land in Elko, Nevada, that is

more
particularly
described
as
NE1⁄4

SW1⁄4 NW1⁄4, N1⁄2SE1⁄4SW1⁄4NW1⁄4, sec. 8, T.

34 N., R. 55 E., of the Mount Diablo Meridian, as

depicted on the map prepared by the Bureau of

Land Management, entitled ‘‘Proposed National
8
Cemetery-Elko Nevada’’, and dated September 9,
9
2015.

(2) SECRETARY.—The term ‘‘Secretary’’ means
11
the Secretary of the Interior.

SEC. 3. TRANSFER AND WITHDRAWAL OF BUREAU OF LAND

MANAGEMENT LAND FOR USE AS A NA-

(a) TRANSFER
OF
ADMINISTRATIVE
JURISDIC-
16
TION.—

(1) IN
GENERAL.—Subject to valid existing
18
rights, administrative jurisdiction over the Federal
19
land is transferred from the Secretary to the Sec-
20
retary of Veterans Affairs for use as a national cem-
21
etery in accordance with chapter 24 of title 38,
22
United States Code.

(2) LEGAL DESCRIPTIONS.—

(A) IN GENERAL.—As soon as practicable
1
after the date of enactment of this Act, the Sec-
2
retary shall publish in the Federal Register a
3
notice containing a legal description of the Fed-
4
eral land.
5
(B) EFFECT.—A legal description pub-
6
lished under subparagraph (A) shall have the
7
same force and effect as if included in this Act,
8
except that the Secretary may correct any cler-
9
ical and typographical errors in the legal de-
10
scription.
11
(C) AVAILABILITY.—Copies of the legal de-
12
scription published under subparagraph (A)
13
shall be available for public inspection in the
14
appropriate offices of—
15
(i) the Bureau of Land Management;
16
and
17
(ii) the National Cemetery Adminis-
18
tration.
19
(D) COSTS.—The Secretary of Veterans
20
Affairs shall reimburse the Secretary for the
21
costs incurred by the Secretary in carrying out
22
this paragraph, including the costs of any sur-
23
veys and other reasonable costs.

(b) WITHDRAWAL.—Subject to valid existing rights,
1
for any period during which the Federal land is under the
2
administrative jurisdiction of the Secretary of Veterans
3
Affairs, the Federal land—
4
(1) is withdrawn from all forms of appropria-
5
tion under the public land laws, including the mining
6
laws, the mineral leasing laws, and the geothermal
7
leasing laws; and
8
(2) shall be treated as property (as defined in
9
section 102 of title 40, United States Code).
