A BILL
To amend the National Firearms Act to require that local
chief law enforcement officers be notified of, and pro-
vided a 90-day period to deny, firearm transfers.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Empowering Law En-
4
forcement for Safer Firearm Transfers Act of 2021’’.

SEC. 2. NOTIFICATION OF LOCAL CHIEF LAW ENFORCE-

MENT OFFICER IN CASE OF FIREARM TRANS-
2
FER.

(a) IN GENERAL.—Section 5812 of the Internal Rev-
4
enue Code of 1986 is amended by striking ‘‘and (6)’’ and
5
inserting ‘‘(6) the Secretary has notified the chief law en-
6
forcement officer of the jurisdiction in which the trans-
7
feree primarily resides that such application is pending,
8
and such officer either (A) certifies that there is no objec-
9
tion to the transfer, or (B) does not, before the end of
10
the 90-day period beginning on the date of such notifica-
11
tion, certify to the Secretary that (i) the transferee poses
12
a danger to the transferee or others, or (ii) there is a rea-
13
sonable likelihood the transferee will use the firearm for
14
unlawful purposes; and (7)’’.
15
(b) EFFECTIVE DATE.—The amendment made by
16
this section shall apply with respect to applications filed
17
after the date of the enactment of this Act.
