Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. TRANSIT ORIENTED DEVELOPMENT PLANNING 1 GRANT PROGRAM. 2 (a) IN GENERAL.—Chapter 53 of title 49, United 3 States Code, is amended by inserting after section 5327 4 the following: 5 ‘‘§ 5328. Transit oriented development planning grant 6 program 7 ‘‘(a) DEFINITION.—In this section the term ‘eligible 8 project’ means— 9 ‘‘(1) a new fixed guideway capital project or a 10 core capacity improvement project as defined in sec- 11 tion 5309; or 12 ‘‘(2) an existing fixed guideway system, or an 13 existing station that is served by a fixed guideway 14 system. 15 ‘‘(b) GENERAL AUTHORITY.—The Secretary may 16 make grants under this section to a State, local govern- 17 mental authority, or metropolitan planning organization 18 to assist in financing comprehensive planning associated 19 with an eligible project that seeks to— 20 ‘‘(1) enhance economic development, ridership, 21 and other goals established during the project devel- 22 opment and engineering processes or the grant ap- 23 plication; 24 ‘‘(2) facilitate multimodal connectivity and ac- 25 cessibility; 26 VerDate Sep 11 2014 03:47 Apr 30, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1615.IH H1615 kjohnson on DSK79L0C42PROD with BILLS 3 •HR 1615 IH ‘‘(3) increase access to transit hubs for pedes- 1 trian and bicycle traffic; 2 ‘‘(4) enable mixed-use development; 3 ‘‘(5) identify infrastructure needs associated 4 with the eligible project; and 5 ‘‘(6) include private sector participation. 6 ‘‘(c) ELIGIBILITY.—A State, local governmental au- 7 thority, or metropolitan planning organization that desires 8 to participate in the program under this section shall sub- 9 mit to the Secretary an application that contains at a min- 10 imum— 11 ‘‘(1) an identification of an eligible project; 12 ‘‘(2) a schedule and process for the development 13 of a comprehensive plan; 14 ‘‘(3) a description of how the eligible project 15 and the proposed comprehensive plan advance the 16 metropolitan transportation plan of the metropolitan 17 planning organization; 18 ‘‘(4) proposed performance criteria for the de- 19 velopment and implementation of the comprehensive 20 plan; 21 ‘‘(5) a description of how the project will reduce 22 and mitigate social and economic impacts on existing 23 residents and businesses vulnerable to displacement; 24 and 25 VerDate Sep 11 2014 03:47 Apr 30, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1615.IH H1615 kjohnson on DSK79L0C42PROD with BILLS 4 •HR 1615 IH ‘‘(6) identification of— 1 ‘‘(A) partners; 2 ‘‘(B) availability of and authority for fund- 3 ing; and 4 ‘‘(C) potential State, local or other impedi- 5 ments to the implementation of the comprehen- 6 sive plan. 7 ‘‘(d) COST SHARE.—A grant under this section shall 8 not exceed an amount in excess of 80 percent of total 9 project costs, except that a grant that includes an afford- 10 able housing component shall not exceed an amount in ex- 11 cess of 90 percent of total project costs.’’. 12 (b) AUTHORIZATION OF APPROPRIATIONS.—Section 13 5338 of title 49, United States Code, is amended by add- 14 ing at the end the following: 15 ‘‘(i) TRANSIT ORIENTED DEVELOPMENT PLANNING 16 GRANT PROGRAM.—There is authorized to be appro- 17 priated to carry out section 5328— 18 ‘‘(1) $20,000,000 for fiscal year 2022; 19 ‘‘(2) $21,000,000 for fiscal year 2023; 20 ‘‘(3) $22,000,000 for fiscal year 2024; 21 ‘‘(4) $23,000,000 for fiscal year 2025; and 22 ‘‘(5) $24,000,000 for fiscal year 2026.’’. 23 (c) CLERICAL AMENDMENT.—The analysis for chap- 24 ter 53 of title 49, United States Code, is amended by in- 25 VerDate Sep 11 2014 03:47 Apr 30, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1615.IH H1615 kjohnson on DSK79L0C42PROD with BILLS 5 •HR 1615 IH serting after the item relating to section 5327 the fol- 1 lowing: 2 ‘‘5328.
