SECTION 1. SHORT TITLES.

This Act may be cited as the ‘‘Reporting Efficiently
2
to Proper Officials in Response to Terrorism Act of 2021’’
3
or the ‘‘REPORT Act’’.
4
SEC. 2. DUTY TO REPORT.
5
(a) DUTY IMPOSED.—Except as provided in sub-
6
section (c), whenever an act of terrorism occurs in the
7
United States, it shall be the duty of the primary Govern-
8
ment agency investigating such act to submit, in collabora-
9
tion with the Secretary of Homeland Security, the Attor-
10
ney General, the Director of the Federal Bureau of Inves-
11
tigation, and, as appropriate, the Director of the National
12
Counterterrorism Center, an unclassified report (which
13
may be accompanied by a classified annex) to Congress
14
concerning such act not later than 1 year after the comple-
15
tion of the investigation. Reports required under this sub-
16
section may be combined into a quarterly report to Con-
17
gress.

(b) CONTENT OF REPORTS.—Each report under this
19
section shall include—
20
(1) a statement of the facts of the act of ter-
21
rorism referred to in subsection (a), as known at the
22
time of the report;
23
(2) an explanation of any gaps in national secu-
24
rity that could be addressed to prevent future acts
25
of terrorism;

(3) any recommendations for additional meas-
1
ures that could be taken to improve homeland secu-
2
rity, including potential changes in law enforcement
3
practices or changes in law, with particular attention
4
to changes that could help prevent future acts of ter-
5
rorism; and
6
(4) a summary of the report for public distribu-
7
tion.

(c) EXCEPTION.—
9
(1) IN GENERAL.—The duty established under
10
subsection (a) shall not apply in instances in which
11
the Secretary of Homeland Security, the Attorney
12
General, the Director of the Federal Bureau of In-
13
vestigation, or the head of the National Counterter-
14
rorism Center determines that the information re-
15
quired to be reported could jeopardize an ongoing in-
16
vestigation or prosecution.
17
(2) NOTIFICATION REQUIREMENT.—In each in-
18
stance described in paragraph (1), the principal
19
making a determination under such paragraph shall
20
notify Congress of such determination not later than
21
1 year after the completion of the related investiga-
22
tion described in subsection (a).
23
(d) DEFINED TERM.—In this section, the term ‘‘act
24
of terrorism’’ means an act of domestic terrorism or inter-

national terrorism (as such terms are defined in section
1
2331 of title 18, United States Code).

(e) SUNSET.—This section shall cease to be effective
3
beginning on the date that is 5 years after the date of
4
the enactment of this Act.
