AN ACT
To provide for the conveyance of certain property to the
Tanana Tribal Council located in Tanana, Alaska, and
for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. CONVEYANCE OF PROPERTY TO THE TANANA

TRIBAL COUNCIL.
2
(a) CONVEYANCE OF PROPERTY.—
3
(1) IN GENERAL.—As soon as practicable, but
4
not later than 180 days, after the date of enactment
5
of this Act, the Secretary of Health and Human
6
Services (referred to in this Act as the ‘‘Secretary’’)
7
shall convey to the Tanana Tribal Council located in
8
Tanana, Alaska (referred to in this section as the
9
‘‘Council’’), all right, title, and interest of the United
10
States in and to the property described in subsection
11
(b) for use in connection with health and social serv-
12
ices programs.

(2) CONDITIONS.—The conveyance of the prop-
14
erty under paragraph (1)—
15
(A) shall be made by warranty deed; and
16
(B) shall not—
17
(i) require any consideration from the
18
Council for the property;
19
(ii) impose any obligation, term, or
20
condition on the Council; or
21
(iii) allow for any reversionary interest
22
of the United States in the property.

(3) EFFECT ON ANY QUITCLAIM DEED.—The
24
conveyance by the Secretary of title by warranty
25
deed under paragraph (1) shall, on the effective date
26

of the conveyance, supersede and render of no future

effect any quitclaim deed to the property described
2
in subsection (b) executed by the Secretary and the
3
Council.

(b) PROPERTY DESCRIBED.—The property, including
5
all land, improvements, and appurtenances, described in
6
this subsection is the property included in U.S. Survey No.
7
5958 in the village of Tanana, Alaska, within surveyed lot
8
12, T. 4 N., R. 22 W., Fairbanks Meridian, Alaska, con-
9
taining 11.25 acres.

(c) ENVIRONMENTAL LIABILITY.—

(1) LIABILITY.—

(A) IN
GENERAL.—Notwithstanding any
13
other provision of law, the Council shall not be
14
liable for any soil, surface water, groundwater,
15
or other contamination resulting from the dis-
16
posal, release, or presence of any environmental
17
contamination on any portion of the property
18
described in subsection (b) on or before the
19
date on which the property is conveyed to the
20
Council.

(B) ENVIRONMENTAL
CONTAMINATION.—
22
An environmental contamination described in
23
subparagraph (A) includes any oil or petroleum
24
products, hazardous substances, hazardous ma-
25

terials, hazardous waste, pollutants, toxic sub-
1
stances, solid waste, or any other environmental
2
contamination or hazard as defined in any Fed-
3
eral or State of Alaska law.

(2) EASEMENT.—The Secretary shall be ac-
5
corded any easement or access to the property con-
6
veyed under this section as may be reasonably nec-
7
essary to satisfy any retained obligation or liability
8
of the Secretary.

(3) NOTICE OF HAZARDOUS SUBSTANCE ACTIV-
10
ITY AND WARRANTY.—In carrying out this section,
11
the Secretary shall comply with subparagraphs (A)
12
and (B) of section 120(h)(3) of the Comprehensive
13
Environmental Response, Compensation, and Liabil-
14
ity Act of 1980 (42 U.S.C. 9620(h)(3)).
