A BILL
To authorize the Secretary of Health and Human Services,
acting through the Director of the Center for Mental
Health Services of the Substance Abuse and Mental
Health Services Administration, to award grants to facili-
tate the funding of community-based mental health and
substance use disorder services and peer support pro-
grams, and for other purposes.
Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.
3
This Act may be cited as the ‘‘Virtual Community
4
Support Act of 2021’’.

SEC. 2. GRANT FOR COMMUNITY-BASED MENTAL HEALTH

AND SUBSTANCE USE DISORDER SERVICES
2
AND PEER SUPPORT PROGRAMS.

(a) IN GENERAL.—Not later than 15 days after the
4
date of the enactment of this Act, the Secretary of Health
5
and Human Services, acting through the Director of the
6
Center for Mental Health Services of the Substance Abuse
7
and Mental Health Services Administration, shall estab-
8
lish a program (in this Act referred to as the ‘‘Program’’)
9
to facilitate the funding of community-based mental health
10
and substance use disorder services and peer support pro-
11
grams.
12
(b) GRANT AUTHORITY.—In carrying out the Pro-
13
gram, the Secretary shall award a grant in accordance
14
with this section.
15
(c) ELIGIBLE
RECIPIENTS.—The Secretary may
16
award a grant under the Program to an eligible recipient
17
determined by the Secretary to be authorized and capable
18
of carrying out a project described in subsection (d).
19
(d) ELIGIBLE PROJECTS.—Grant funds awarded
20
under the Program may be used to—
21
(1) identify and coordinate care between pro-
22
grams that provide access to community-based men-
23
tal health and substance use disorder services for ju-
24
veniles and assist in the coordination of such serv-
25
ices;

(2) identify and coordinate care between pro-
1
grams that provide access to community-based men-
2
tal health and substance use disorder services for
3
adults and assist in the coordination of such serv-
4
ices;
5
(3) obtain technology required to provide a
6
community-based mental health and substance use
7
disorder services virtually;
8
(4) compensate a healthcare provider or a peer
9
specialist for the provision of community-based men-
10
tal health and substance use disorder services;
11
(5) provide education assistance to an indi-
12
vidual seeking certification as a peer specialist;
13
(6) provide for workforce development, recruit-
14
ment, and retention activities, to train, recruit, and
15
retain peer specialists;
16
(7) transition a network of in-person, peer spe-
17
cialist facilitated behavioral health support services
18
to a virtual platform for such behavioral health sup-
19
port services; or
20
(8) expand or improve virtual, peer specialist
21
facilitated behavioral health support services carried
22
out by the entity prior to the date of enactment of
23
this section.

(e) APPLICATIONS.—To be eligible for a grant under
1
the Program, an eligible recipient shall submit to the Sec-
2
retary an application in such form, at such time, and con-
3
taining such information as the Secretary determines to
4
be appropriate.
5
(f) GUIDANCE.—Not later than 15 days after the
6
date of the enactment of this Act, the Secretary shall issue
7
guidance on the requirements an eligible recipient shall
8
take to provide community-based mental health and sub-
9
stance use disorder services.
10
(g) SUPPLEMENT NOT SUPPLANT.—Federal funds
11
paid to an eligible recipient pursuant to the Program must
12
be used to supplement, but not supplant, any other Fed-
13
eral, State, or local funds available to such eligible recipi-
14
ent.

(h) REPORT.—
16
(1) INTERIM REPORT.—Not later than 90 days
17
after the date on which funds are distributed under
18
the Program, the Secretary shall submit to Congress
19
a report on the Program that includes—
20
(A) the number of grants awarded under
21
the Program;
22
(B) the location of each grant awarded
23
under the Program; and

(C) the amount requested and amount
1
awarded for each grant under the Program.

(2) REPORT.—Not later than 30 days after the
3
end of the COVID-19 emergency period, the Sec-
4
retary shall submit to Congress a report on the Pro-
5
gram that includes—
6
(A) the number of grants awarded under
7
the Program;
8
(B) the location of each grant awarded
9
under the Program; and
10
(C) the amount requested and amount
11
awarded for each grant under the Program.

(3) PUBLICATION REQUIREMENT.—On the date
13
on which a report is submitted under paragraphs (1)
14
or (2), the Secretary shall publish such report sub-
15
mitted on the website of the Department of Health
16
and Human Services.
17
(i) AUTHORIZATION OF APPROPRIATIONS.—There is
18
authorized to be appropriated to carry out the Program—
19
(1) during the COVID-19 emergency period,
20
such sums as may be necessary for each of the fiscal
21
years such emergency period is ongoing; and
22
(2) after the COVID-19 emergency period,
23
$5,000,000 for each of the five fiscal years begin-

ning after the termination of the COVID-19 emer-

gency period.

(j) DEFINITIONS.—In this section:
3
(1) COVID-19 EMERGENCY PERIOD.—The term
4
‘‘COVID-19 emergency period’’ means the public
5
health emergency declared by the Secretary of
6
Health and Human Services on January 27, 2020,
7
with respect to the 2019 novel coronavirus.
8
(2) ELIGIBLE RECIPIENT.—The term ‘‘eligible
9
recipient’’ means—
10
(A) a department of health or a depart-
11
ment of public health, in coordination with a
12
State;
13
(B) a behavioral health program that pri-
14
marily serves individuals with mental health or
15
substance abuse disorders;
16
(C) community-based nonprofit, that is a
17
consumer-controlled and is certified in accord-
18
ance with applicable State law to deliver peer
19
specialist support services at a State or local
20
level; or
21
(D) an institution of higher education pro-
22
viding service learning and civic-engagement
23
courses for peer specialist training.

HEALTHCARE
PROVIDER.—The
term
1
‘‘healthcare provider’’ mean a certified provider who
2
provides behavioral health services.
3
(4) PEER SPECIALIST.—The term ‘‘peer spe-
4
cialist’’ includes—
5
(A) a certified peer specialist;
6
(B) a peer recovery support specialist; and
7
(C) a recovery coach for behavioral health.
8
(5) STATE.—The term ‘‘State’’ means a State
9
of the United States, the District of Columbia, or
10
any commonwealth, territory, or possession of the
11
United States, or an Indian tribe.
