SHORT TITLE. 1 This Act may be cited as the ‘‘Informed Consent 2 Act’’. 3 SEC. 2. ABORTION AND STERILIZATION. 4 (a) IN GENERAL.—Chapter 7 of title 18, United 5 States Code, is amended by adding at the end the fol- 6 lowing: 7 ‘‘§ 120. Abortion and sterilization without informed 8 consent 9 ‘‘(a) OFFENSE.—Whoever, under the circumstances 10 described in subsection (b), knowingly performs an abor- 11 tion or a sterilization procedure on a person without the 12 informed consent of such person shall be fined under this 13 title, imprisoned not more than 10 years, or both. 14 ‘‘(b) CIRCUMSTANCES DESCRIBED.—For purposes of 15 subsection (a), the circumstances described in this sub- 16 section are that— 17 ‘‘(1) the defendant is an officer, employee, or 18 contractor of the Federal Government; 19 ‘‘(2) the defendant is a recipient of Federal 20 funds from the Secretary of Health and Human 21 Services or a program administered by the Secretary 22 of Health and Human Services; or 23 ‘‘(3) the conduct described in subsection (a) oc- 24 curred in or affected interstate commerce. 25 ‘‘(c) EXCEPTIONS.— 26 VerDate Sep 11 2014 04:52 Mar 31, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1382.IH H1382 pbinns on DSKJLVW7X2PROD with BILLS 3 •HR 1382 IH ‘‘(1) IN GENERAL.—Subsection (a) does not 1 apply— 2 ‘‘(A) in the case that a woman suffers 3 from a physical disorder, physical injury, or 4 physical illness that would, as certified by a 5 physician, place the woman in danger of death 6 unless an abortion is performed, including a 7 life-endangering physical condition caused by or 8 arising from the pregnancy itself and not in- 9 cluding psychological or emotional conditions; 10 or 11 ‘‘(B) if, in reasonable medical judgement, 12 a sterilization procedure is necessary to— 13 ‘‘(i) save the life of an individual 14 whose life is endangered by a physical dis- 15 order, physical illness, or physical injury, 16 including a life-endangering physical condi- 17 tion caused by or arising from the repro- 18 ductive organs of the individual and not in- 19 cluding psychological or emotional condi- 20 tions; or 21 ‘‘(ii) to prevent serious risk of sub- 22 stantial and irreversible impairment of a 23 major bodily function created by a delay. 24 VerDate Sep 11 2014 04:52 Mar 31, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1382.IH H1382 pbinns on DSKJLVW7X2PROD with BILLS 4 •HR 1382 IH ‘‘(2) WITHHOLDING OF CONSENT.—Paragraph 1 (1) shall not apply if the individual on whom an 2 abortion or sterilization procedure is performed has 3 explicitly refused to consent to the abortion or steri- 4 lization procedure. 5 ‘‘(d) CONDUCT OF INDIVIDUALS WITH KNOWLEDGE 6 OF VIOLATIONS.—Whoever, being an officer, employee, or 7 contractor of the Federal Government or an employee or 8 contractor of a recipient of Federal funds from the Sec- 9 retary of Health and Human Services or a program ad- 10 ministered by the Secretary of Health and Human Serv- 11 ices, has knowledge of a failure to comply with subsection 12 (a) and does not, as soon as possible, make known the 13 same to a Federal or State law enforcement agency, shall 14 be fined under this title or imprisoned not more than three 15 years, or both. 16 ‘‘(e) DEFINITIONS.— 17 ‘‘(1) ABORTION.—The term ‘abortion’ means 18 the use or prescription of any instrument, medicine, 19 drug, or any other substance or device— 20 ‘‘(A) to intentionally kill the unborn child 21 of a woman known to be pregnant; or 22 ‘‘(B) to intentionally terminate the preg- 23 nancy of a woman known to be pregnant, with 24 an intention other than— 25 VerDate Sep 11 2014 04:52 Mar 31, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H1382.IH H1382 pbinns on DSKJLVW7X2PROD with BILLS 5 •HR 1382 IH ‘‘(i) after viability to produce a live 1 birth and preserve the life and health of 2 the child born alive; or 3 ‘‘(ii) to remove a dead unborn child. 4 ‘‘(2) REASONABLE MEDICAL JUDGMENT.—The 5 term ‘reasonable medical judgment’ means a medical 6 judgment that would be made by a reasonably pru- 7 dent physician, knowledgeable about the case and 8 the treatment possibilities with respect to the med- 9 ical conditions involved. 10 ‘‘(3) STERILIZATION PROCEDURE.—The term 11 ‘sterilization procedure’ means any medical proce- 12 dure, treatment, or operation for the purpose of ren- 13 dering an individual permanently incapable of repro- 14 ducing.’’. 15 (b) CLERICAL AMENDMENT.—The table of sections 16 for chapter 7 of title 18, United States Code, is amended 17 by adding at the end the following: 18 ‘‘120.
