Be it enacted by the Senate and House of Representa-

tives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘Eric Garner Excessive
4
Use of Force Prevention Act of 2021’’.

SEC. 2. CHOKEHOLDS AS CIVIL RIGHTS VIOLATIONS.

Section 242 of title 18, United States Code, is
7
amended by adding at the end the following: ‘‘For the pur-
8
poses of this section, the application of any pressure to
9
the throat or windpipe, use of maneuvers that restrict
10
blood or oxygen flow to the brain, or carotid artery re-
11
straints which prevent or hinder breathing or reduce in-
12
take of air is a punishment, pain, or penalty.’’.
