Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. INCREASING THE CHIP ENHANCED FMAP TO HELP 1 STATES RESPOND TO THE COVID–19 PAN- 2 DEMIC. 3 Section 2105(b) of the Social Security Act (42 U.S.C. 4 1397ee(b)) is amended— 5 (1) by striking ‘‘For purposes of subsection 6 (a),’’ and inserting the following: 7 ‘‘(1) IN GENERAL.—For purposes of subsection 8 (a),’’; 9 (2) in the second sentence— 10 (A) by inserting ‘‘, subject to paragraph 11 (2),’’ after ‘‘23 percentage points, and’’; and 12 (B) by striking ‘‘September 30, 2020’’ and 13 inserting ‘‘September 30, 2022’’; and 14 (3) by adding at the end the following new 15 paragraph: 16 ‘‘(2) REQUIREMENTS.—During the period that 17 begins on October 1, 2020, and ends on September 18 30, 2022, a State shall not receive the increase de- 19 scribed in the second sentence of paragraph (1) to 20 the enhanced FMAP for such State, with respect to 21 a quarter that occurs during such period, if— 22 ‘‘(A) the amount of any premium imposed 23 by the State under the State child health plan 24 (or a waiver of such plan) during such quarter, 25 with respect to an individual enrolled under 26 VerDate Sep 11 2014 03:36 Mar 18, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S453.IS S453 kjohnson on DSK79L0C42PROD with BILLS 3 •S 453 IS such plan (or waiver), exceeds the amount of 1 such premium as of January 1, 2020; 2 ‘‘(B) the State fails to provide that an in- 3 dividual who is enrolled for benefits under such 4 plan (or waiver) as of the date of enactment of 5 this paragraph or enrolls for benefits under 6 such plan (or waiver) during the period begin- 7 ning on such date of enactment and ending on 8 the last day of the month in which the emer- 9 gency period defined in paragraph (1)(B) of 10 section 1135(g) ends shall be treated as eligible 11 for such benefits through the end of the month 12 in which such emergency period ends unless the 13 individual requests a voluntary termination of 14 eligibility or the individual ceases to be a resi- 15 dent of the State; 16 ‘‘(C) the State does not provide coverage 17 under such plan (or waiver), without the impo- 18 sition of cost sharing, during such quarter for 19 any testing services and treatments for 20 COVID–19, including vaccines, specialized 21 equipment, and therapies; 22 ‘‘(D) the State imposes a waiting period 23 under the State child health plan prior to the 24 VerDate Sep 11 2014 03:36 Mar 18, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\S453.IS S453 kjohnson on DSK79L0C42PROD with BILLS 4 •S 453 IS provision of child health assistance to a tar- 1 geted low-income child; or 2 ‘‘(E) the State fails to take active meas- 3 ures (as determined by the Secretary) to iden- 4 tify and re-enroll children who are eligible for 5 child health assistance under the State plan and 6 who were previously enrolled in such plan.’’. 7 Æ VerDate Sep 11 2014 03:36 Mar 18, 2021 Jkt 019200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\S453.IS S453 kjohnson on DSK79L0C42PROD with BILLS
