Be it enacted by the Senate and House of Representa- 1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Confederate Monu- 4 ment Removal Act’’. 5 SEC. 2. REQUIREMENTS AND REMOVAL PROCEDURES. 6 (a) REQUIREMENTS.—Section 1814 of the Revised 7 Statutes (2 U.S.C. 2131) is amended by inserting ‘‘(other 8 than persons who served voluntarily with the Confederate 9 States of America)’’ after ‘‘military services’’. 10 VerDate Sep 11 2014 02:48 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\S366.IS S366 kjohnson on DSK79L0C42PROD with BILLS 2 •S 366 IS (b) STATUE REMOVAL PROCEDURES.— 1 (1) IN GENERAL.—The Architect of the Capitol 2 shall— 3 (A) identify all statues on display in the 4 United States Capitol that do not meet the re- 5 quirements of section 1814 of the Revised Stat- 6 utes (2 U.S.C. 2131), as amended by subsection 7 (a); and 8 (B) subject to the approval of the Joint 9 Committee on the Library of Congress, arrange 10 for the removal of each such statue from the 11 Capitol by not later than 120 days after the 12 date of enactment of this Act. 13 (2) REMOVAL AND RETURN OF STATUES.—In 14 the case of a statue that is removed under this sub- 15 section which was provided for display by a State, 16 the Architect of the Capitol shall arrange to transfer 17 and deliver the statue and transfer ownership of the 18 statue to the State if the State so requests and 19 agrees to pay any costs related to the transportation 20 of the statue to the State. 21 (3) REPLACEMENT OF STATUES.—A State that 22 has a statue removed under this subsection shall be 23 able to replace such statue in accordance with the 24 requirements and procedures of section 1814 of the 25 VerDate Sep 11 2014 02:48 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\S366.IS S366 kjohnson on DSK79L0C42PROD with BILLS 3 •S 366 IS Revised Statutes (2 U.S.C. 2131) and section 311 of 1 the Legislative Branch Appropriations Act, 2001 (2 2 U.S.C. 2132). 3 (4) AUTHORIZATION AND APPROPRIATIONS.— 4 (A) IN GENERAL.—There are appropriated 5 for the fiscal year ending September 30, 2021, 6 out of any money in the Treasury not otherwise 7 appropriated, $2,000,000 to the Architect of 8 the Capitol to carry out this section, including 9 the costs related to the removal, transfer, secu- 10 rity, storage, and display of the statues de- 11 scribed in paragraph (1)(A). 12 (B) AVAILABILITY.—Amounts appro- 13 priated under subparagraph (A) shall remain 14 available until expended. 15 Æ VerDate Sep 11 2014 02:48 Mar 02, 2021 Jkt 019200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\S366.IS S366 kjohnson on DSK79L0C42PROD with BILLS
